OK, it appears the kids were 18. Can we drop the whole child porn issue? If this had been a childporn case, the prosecutors would have jumped on it as fast as possible.
"He showed it to other teachers? Well, wouldn't it be infinitely creepier if he didn't?"
No. If he decided that disciplining the students was necessary, he should have told the other people in charge of handling such cases and shown them the video so they could see for themselves. It was completely unnecessary and inappropriate to show a bunch of random teachers.
"If a doctor is examining a patient of the opposite sex, I believe they are required to have another person present (such as a nurse)."
My doctor is of the opposite sex and she examines me without a male nurse present. I know several women who go to male doctors who examine them without a female nurse present. What kind of doctor do you go to?
It's not the location that is private or not. It is the expectation of privacy that matters. I would not expect anyone to see whatever I was doing alone in the cafeteria after school when I can see no-one looking at me. Also, if the janitor walks in, you can stop what you are doing. If you don't realize there is a camera trained on you, you don't have the same opportunity to stop.
Yes, that would be excessive if the charges don't get erased at 18. On the other hand, I believe the kid also got a reckless endangerment charge when he had charged a bunch of girls with his car in order to scare them. So the identity theft charge might not change much for him.
Hm... A DUI is a much more crime than identity theft. A DUI means you are recklessly putting lives at risk. I don't have any sympathy for those who drive under the influence of drugs or alcohol.
Well, the enforcement of the law is an important goal because it creates a predictable environment in which we can all act with little fear of arbitrary punishment or arbitrary lack of protection. It is true that this kid's prank may have caused significant suffering to his victim and there should be a fairly high predictability that such actions have severe consequences as a deterrent. Now, going to jail might be extreme, but a fine and community service would be appropriate.
I think the problem is that most likely the identity fraud statutes assumed that your identity was "stolen" (Somebody is going to have to explain to me how it is your identity can be stolen unless it's a broader commentary on the way commercialization of our social and economic relationships subsumes our identities.) to steal your money, use your credit rating, sign up for health insurance or some other very damaging thing. The interesting question would be what sentence the kid got. As long as he got off with community service and a fine, I don't think it's a problem. If he went to jail, that's a bit excessive.
Nobody said anything about "above the law". Sure, Summit might be legally able to make those people cease their promotion activities. But Summit is also allowed to not sue and to just give a license to the fans so they can keep on promoting the movie. The point is that Summit is acting stupidly and counter to its interests when it is attacking its fans. Mike is simply pointing that out. But hey, if you think it's good business to make your fans terrified of you and wanting to punch you in the face, let us know how that works out for you.
More important disclaimer: I have not seen the Twilight series, I have not read the paper compilations. (I don't think the word book applies) My exposure to it has been only through second hand stories and from everything I hear, you're better off gouging your eyes out than reading/watching it. So really, a part of me is thankful that Twilight fans might be sued out of existence. That way, it will all go away and we can forget it ever existed thereby making the world a better place.
As much as I disagree with groups such as Anonymous over their tactics, I think I understand them. Yes, hacking is wrong and so is violence and I don't condone it. But when I read a story like that, I feel a powerful urge to just hit the Summit execs who made that decision. Thankfully, I don't know any of them so the anger passes. Somehow, I don't think that provoking people into wanting to hit you is a good business strategy. Unless they are planning on releasing a punching bad line in which case good job Summit!
PS: Because apparently companies above a certain size need to be told everything explicitly, I am not advocating illegal violence against your executives or employees. Anyone who actually does commit such violence deserves to go to jail. I'm just saying that maybe the legislature should change the law so you too spend the rest of your miserable lives in jail.
It's looking like there's going to be a follow-up patent case though. The basic thrust of the argument was that the design could not be trademarked because it was covered by a desig patent.
That happens to be true and it is actually even more absurd than that. The cuts are not even binding because future Congresses are not bound by previous Congresses. So really, the cuts are a promise that some guys in the future will spend less money than the current Congress had previously imagined. In other words, it means nothing.
