Well, this geek is also a formally educated semi-professional classical musician, so let me give it a shot here.
The only intent for an artist, regardless of the medium, is that of expression. That expression can be of any number of things: emotional, political, social commentary, parody, etc...
Now, some artists specifically create for the purpose of soliciting public reaction; they like being controversial.
The problem with having any one person deciding what a piece of art 'says' is that even among artistic 'experts', you can (and will usually) get differing opinions, and they are just that: opinions.
And finally, all people are consumers of art, even those who don't create it. Just because they don't create art, doesn't mean they can't appreciate it and have opinions about it. If you are the AC I think you are, your entire livelihood depends on us 'stupid geeks' consuming your artists' work.
OK, so leaving the ad hominem attack out. Assuming intent matters so much, are you ready to accept that position when innocent infringement occurs? Or, is it like all of your other arguments, only a one-way street in your favor?
IANAL, nor do I play one in the blogosphere (like some epople who will remain unnamed...), but would the end result of this law be that less products would be available in Washington? They couldn't force other states to play by Washington's stupid law, right?
Funny, first thing I thought when I read Plan B was the next day prevent pregnancy pill, which, I think, most of IV's (And Ronald J. Riley's) parents were remiss in not taking advantage of.
Well, except my employer when I have to travel to Europe or the Middle East for work. They kind of like me to get there in a matter of hours rather than days or weeks.
taking other peoples music and mixing it differently isnt creating, thats just modified version of someone elses work, create your own music, dont steal from others
I challenge you to find ANY song that was not inspired or built from 'someone else's' work. Any.
All music is created by building on the music that came before it. You name any piece of music that you think is original, and someone will be able to find a previous piece that it was built from. That is how music works. As the late, great Leonard Bernstein once said, "A composer is the sum total of his listening experience"
This is more akin to a bar where most people go and enjoy themselves, but some of the ladies are there to make a buck. They advertise their, um, wares and a fellow takes her up on it and they go do the deed in his car in the parking lot.. or at a nearby hotel.
Personally I think that broadband ISPs are getting out of control and the FCC better pick up their game when it comes to Net Neutrality sooner rather than later.
Um, I do NOT want the FCC anywhere near this one. It's their fault that the last mile is not open to competition. I would rather see the FTC grow a pair and start slapping these clowns around.
Yes it is. When they follow you with a helicopter, or unmarked car, they do not altar your personal property. They had to physically break into his car to plant that device, so that should have been a clear indication that they would need a warrant to do so.

If you're REALLY ready to back that argument, then you'd better be ready for the flood of 'Innocent Infringer' defenses.
