E-PARASITE eliminates this (very important) defense. That is, E-PARASITE is based entirely on accusation, not a court of law (even if that only means a warrant issued by a judge).

Nothing, nothing at all, since you have been conditioned to repurchasing your music every few years, when the latest and greatest format is announced (LP>8-track>cassette>CD>MP3>????).
The problem I see is that when the 'average joe' sees that DRM is easily circumvented (as per Rhapsody's instructions), why wouldn't (s)he assume that, if it is legal to circumvent Rhapsody's DRM, that it is then 'legal' to circumvent all DRM?
After all, if it's OK with this company, why would it not be OK with other companies?
Do you mean hold them underwater (deprive them of air (money))? If they do not drown then they're a witch (infringer)? If they do drown (die) then they're innocent?
I almost always click on it, too, but, at least I am warned ahead of time that the poster has no real argument.
If I am short on time, irritated in the first place, or just genuinely want to follow an actual, reasoned argument, I at least know (based on the, IMO, good judgment and intelligence of most Techdirt readers) that I can in good faith skip the flagged comment.

Agreed. If said troll cannot give a cogent argument, but instead slings 'pirate mike', 'chubby, 'left-sided haircut' (really, wtf is that? Certainly not a proper insult, lol), etc., hit "report" and move on.
