Wow, your ignorance of how music is created is amazing!
As Berenerd already pointed out, all music is influenced by something else. The Beatles were influenced by other music (though, since I don't listen to the Beatles, I don't know who their influences were). I have news for you, most (popular) music after the Beatles was probably influenced in one way or another by them.
Try applying that same logic to other genres (art, literature, movies, books, etc) and see how well they work.
Re: SOON? "we'll soon buy ... newspapers straight over the Intenet"
Really? You're rant is focused on the word BUY?
I own one of those "toy" readers (complete aside, please define a "real" reader, will you?), and I have 'bought' several (well over 100) titles for it at the tidy sum of $0.00.
Your second paragraph is so far off as to be laughable. Do you think for one minute that if the internet didn't exist the market for those "toy" readers would have had anywhere near the success they have had?
Good point on the 2nd question. The PI is obviously a both legally and civilly liable. The ESA... should seem that once they took possession of the illegal tapes, one could make an argument that they were complicit, and therefor liable.
Full disclosure: IANAL, nor am I darryl or average_joe. :)
No.. it's a hellua a lot worse! Just ask the MPAA/RIAA...pick your favorite acronym. there is nothing in the world that is worse than someone disrupting their business model.
In reading the article, they are not making a 4th Amendment argument per se. They are arguing that the trial could get bogged down when they cross examine the PI about the illegal tapes.
Separately, I wonder if the defendant could sue the ESA ( the company that hired the PI) and/or the PI for the illegal invasion of privacy. this could make for enjoyable times.
And I'm not arguing that Music/art is necessary for survival. Most of the things we have and do are not strictly necessary for survival.
I will concede from a purely economical standpoint it is frivolous. But I hold my position that it has been historically important and not just frivolous.
full disclosure is probably in order: I have been a classical musician for 30 years, though it is not my profession.
Your assertion was that ALL art was frivolous. I was pointing out that throughout history, art has served utile functions.
Yes, Twinkle Twinkle AIDED your learning of the alphabet. Made it easier. that's not frivolous. I didn't say it was the ONLY reason you learned you f***ing ABC's, I just said it made it EASIER.
Hunting calls helped the hunt, yes the hunt went on without it too.
you realize that a lot of history was preserved through ART right?
It's also VERY condescending to presume that art is only there for yours or my enjoyment. Again, you apparently need to take a humanities course to even remotely understand what I'm saying.
What does technology have to do with it? Just because it may be easy to do something doesn't make it right. Infamous Joe, what do you think the charge would be if you stopped a politician on the street, then tied him up and held him against his will in a van for 30 mins?
There are so many disconnect with that analogy that it boggle my mind that any reasonably intelligent adult could have made it. i will attack the obvious though.
A DDOS on a web site is not even REMOTELY close to physically holding a PERSON hostage. I would say it is more along the lines of unplugging his microphone for 30 minutes. He can still talk and use other platforms, like say a different microphone.
I think you need to see a doctor about your cranial-rectal reversal disorder.

Re: Re: Music as frivolous pursuit
Perhaps you learned the alphabet without the help of that useless "Twinkle, Twinkle" tune then, right?
Or did you know, that the earliest forms of music were hunting calls played on hollowed out animal horns and were used to help organize hunts?
I would suggest that you seriously bone up on your humanities before making such a broad and uninformed statement.
