It very well may not be stupidity, but just the appearance of it. Playing verbal dodgeball may have kept him from giving testimony that could be used against him or his company. Also, keep in mind that many depositions have a time limit. This IT guy managed to get the lawyer to waste an incredible amount of time over ONE question. Someone else said that they felt the guy was coached to respond that way and I tend to agree. I'd say that it was a pretty decent job by the IT guy (if those were his intentions).
Essentially, this ruling would be a gut job on copyright, as it would first shift the burden in fair use cases. It would make fair use the default, and require the plaintiff to show that the use isn't fair. It would require the showing that the use specifically hurt creativity. That is not what the copyright laws require at all, and is an incredible (and seemingly intentional) attempt to scrap the vast majority of the copyright law in a single swipe.
I'm not sure I'd say the average Internet user is better, they just have the choice now to shun the places that spew the bullshit they don't believe. In days of old, you only had what the old media gave you.
No, he's saying that if you don't buy a CD and chose to pirate your music, you should donate the money you would have spent on music to the pirate site where you got your music. That way, the whole economy maintains its balance.

So, it's OK to assume that every instance of piracy (or at least some instances) lead to a lost sale, but it's not OK for anyone to assume that an instance of piracy can lead to sale that wouldn't have occurred with the piracy?
