How, in your wildest misreasonings, can I possibly "tamper" with ---MY--- personal and private property? Or are you laboring under some bizzare legal theory that even after I paid US legal tender directly to Apple in exchange for my iPhone(s), that they somehow still own the article in question??

I am the proud owner of three unlocked, jailbroken iPhones used by my family. I am basically happy but there are small but constant annoyances with various aspects of the software that if I had access to the source code, I know I could fix quickly.
So...the most important thing this whole experience has taught me is, that just as soon as there is a truly open iPhone handset clone (WAKE THE HELL UP FIC!!!), I will drop Steve Jobs and Apple Lock-In Systems like a bucket of bad clams.
The 2012 Olympic(tm)(c)(Patent Pending) Committee has just announced that it has filed a lawsuit against Cunard-White Star Lines for "gross and negligent intellectual property infringement, abduction and subversion".
An Olympic Committee spokesperson in an interview said, "How dare they! There it is! In letters 5 feet tall on the side of that rusting hulk at the bottom of the ocean. The word "Olympic" is ours and ours alone and the Cunard-White Star Line needs to have our word removed from thier nasty old crumpled shipwreck. Do you know how many submariners read that word everyday without compensating us for the pleasure?"
A Cunard official, when contacted for a comment, laughed and then called the Olympic Committee "a bunch of titanic idiots".
Assuming for a millisecond that the patent is actually valid, why on earth would you sue several LARGE companies at once?? They will only POOL their financial and legal resources and align them against you.
Next time, try suing the SMALLEST company first, pray for a win and -THEN- use that judgment as leverage against the big boyz.
And I wonder if the new "obviousness" guidelines are to be used when reviewing patents?? Or will they be reviewed only under the standard they were granted under??

Several folks here keep referring to a supposed fact that iPhone buyers have entered into some form of legal licensing agreement with their iPhones. While this may be the case for most people, it is not universally true.
I bought my iPhones as refurbs direct from Apple. There was never any 'Activation' or AT&T signup via iTunes and never any click thru agreements due to the use of various software hacks, tricks and workaraounds available. --I-- am under absolutely no obligation to either Apple or AT&T. The iPhone is mine to do with as I wish.
That said, I realize that Apple owes me nothing either...EXCEPT...
...that Apple does have a moral and ethical obligation to the compusphere to fix security holes in its products. The 1.0.2 version has several Safari vulnerabilities and one very nasty BlueTooth hole. Apple needs to release a patch to fix these holes (and ONLY fix these holes) if it wishes to remain a good "computing security citizen".
I have three iPhones and they will all stay at 1.0.2. until an iPhone clone handset becomes available and OpenMoko or QTopia is modded to be iPhone-i-licious.
Sadly there are serious Safari and BlueTooth vulnerabilities in the 1.0.2 release.

The "Walled Garden" is dead. Nobody believes for a second that phones "need to be kept locked to protect the carrier's network".
Jobs can keep this game up but he will not win. The iPhone form factor will be cloned and soon. At that point OpenMoko or QTopia will be modded to give the iPhone software look and feel to the iPhone Clones.
Business plans, like the Apple/AT&T one, that are based upon "Customer Lock-In" are fundamentally immoral as they are grounded in coersion and start your customer relationship off with a big dose of hostility.
Only the greedy refuse to give customers what they want at a fair price.
