They don't need to show cause or actually file charges, just get a judge's rubber stamp, and then let it mold away in the filing cabinet. What does this really accomplish, though? The point that is made is that copyright notice was not attached to the original material, something that the law required for it to be sufficiently 'protected' under the law. Without that notice, the copyright was invalid, and it was never rectified.

Requiring that the accused must file a lawsuit to retrieve their own property is law for the rich, and subjugation for the poor. I think we had a war about that around 235 years ago. Might want to look into it.
Reading through the text of the FOIA, I see nothing that indicates that a non-partisan party must handle the request. It is the responsibility of the agency in possession of the documents to handle the request, which does beg the question why the Sec. of Defense is responding, himself.

It's actually more of an agreement. Anime titles that are not available legally in an area are often fan-subbed and released by loyal fans, who then remove them from their own servers when a legal version is finally available. As well, the fan subbers are sometimes employed for the commercial versions being offered by the studios.
