Marc Randazza, an attorney who is defending NORML in the lawsuit, shared some of his thoughts about the Corvette scenario with MediaPost. "The real analogy is this: You have a 1967 Corvette in your driveway, and you charge people $2.95 to take pictures of it. Someone drives by and doesn't know that you charge to take pictures of it. They take a picture, and you come running out of your house with baseball bat and demand $5,000 or you'll smash in the windows on their car."
The difference here is that he CHOSE to become a rapist he was not (setting aside the nature vs. nurture argument for the moment) BORN one. He was (presumably) an adult and responsible for his own actions. Now don't get me wrong I am not saying I agree with Spif on this but I am just pointing out the analogy is not entirely accurate.
Now for those who actually want to argue the nature vs. nurture angle... DIAF ...it is a moot point that is essentially unprovable on its face because BOTH are relevant factors and it CAN NOT excuse or condone that level of anti-social behavior.
I am fortunate to have FiOS (Currently 25 Mbps down / 20 Mbps up & without Node Sharing or Bandwidth Caps) - I also run a private server in my home to I am not exactly 'normal' usage.
I have deliberately set up an open access point at home. It is firewalled, isolated from the rest of my network and bandwidth limited to 500k (to prevent negative impact on MY use. I am not trying to be an ISP) However if one of my neighbors or customers wants or needs to use that connection under those restrictions they are free to do so, that is what it is there for. I have a secure wireless network as well for my use and those friends I trust that may be at my place, but the idea that somebody might try to make that illegal just chaps my hide.
The FBI may indeed knock at your door and question you, but they CAN'T shut the site down just for talking about it. That is the point. There is a line between talking about it and promoting/encouraging violence. Speech is protected by the First Amendment, actions are not, pretty simple.
