Only if they include a hidden trademark, I guess. If I read this correctly, anything made outside the US that includes some aspect that is trademarked is covered by this ruling. So I'm still trying to understand why a manufacturer would either sell their products for less overseas or not simply mark-up their products over there... hmm.. I'm confused. Hang on, everyone should read theage.com article for themselves and be informed on what their actually saying. Mike gives one example about how 4 movies from 2010 were the most downloaded, well, ok, but that may be splitting hairs, its hardly an egregious mis-characterization of the statistics.

Well, you have to be creative. Sorry, but making money is, and should be, rather difficult. Its easy to layout the same old crap on some physical media, demand a ransom for it, and then bludgeon people over the head and haul them off to jail when technology catches up and give everyman the ability to be a content producer too. Do you really think that's a viable business model looking forward into the future? Do you really think people should will still be filling up cars with fossil fuels to go from place to place in 200 years? 300? Do you really think that stodgy, uncreative corporations will be able to demand premium prices for crap on a plastic disk in 100 years? 50? Even if the technology allows an entire, fully automated production studio that can be placed on a bit of plastic the size of your thumbnail that can churn out stunning 3D original videos by anyone with an imagination? WHAT THE HELL is WRONG with your type?? How do you not see that you can't continue to force people to pay you a bunch of money for the same old crap ad infinitum? Its a losing proposition played by people with a stunningly horrible lack of imagination and a will to keep technology and income streams static just long enough for them to reach retirement. Sorry, that model can't fly anymore. Time to come to grips. Some distributors are offering both regular and Bluray disks with their retail packages. One of my favorite bands, the Pixies, recently offered a limited release premium package with all their releases re-mastered with a really great art book and some other items, one sub-collection of objects featured every band member's autograph. I think these efforts are a step in the right direction. Not the same old "We'll sue each and every fan who makes a copy of our studio dvd" nonsense.

Maybe. Lemme ask you; how many of these stings does the FBI need to make before you start getting nervous about it? A few more? 100? 100 weekly? Should the media start printing "plots discovered" scores like the "body counts" from the Viet Nam war? (If your too young just google 'em) Should we include anyone who is caught with bomb making materials. Now, suppose the FBI started planting evidence about terrorist plots? Illegal you say? Well... lets just keep going down this road, shall we?
Simply asking for the material back implies a lack of fundamental understanding of the nature of the media itself. If the state dept. had it in its mind to some how "trick" Wikileaks into both returning the material and deleting the local copies I think instead they'd have opted for simply legally strong-arming Wikileaks into doing whatever they felt would be necessary to paper-over this little episode. Like bashing down the doors and confiscating their IT equipment, and at the same time getting information on Wikileaks other nodes (being a distributed repository).

Its more of the same nonsense that IP owners want to foist off on the thinking public that says infringement should rise to the level of murder in the eyes of the law and people are stating to take notice and realize that its simply no where near that level.

I don't have any numbers, but I would be surprised if many charities are directly involved in the research they fund. In my CYNICAL head I imagine the breakdown of 100% funds raised is: 75%: charity administration, 20%: Marketing, %5 actually makes its way to the effort its trying to fund. If that's even close to reality, its highly unlikely that a charity would be able to purchase ownership stakes in any disease research. I think they raise what money they can and give it to funds and grants who in turn dole out the cash to the individual research efforts. The fundraisers are highly removed from the actual efforts I suspect.
Um, shouldn't a NON-PROFIT concentrate on its mission, rather than defending a trademark against (perceived) infringement? Or to put it another way; has it been conclusively shown that suing for trademark infringement is a solid path to riches? Seems like a really, really crappy way to raise funds for solving a humanitarian problem.
