When we citizens learn that when a court says anything about "balance" that we lose. The Government will always "produce" something that pushes the "balance" in there favor. The current favorite is National Security. The ends justify the means because "xxxxxxx"(insert terrorism, pedophile, drugs whatever pushes the balance...)
