    Jury of Peers

    I agree with the above poster. A jury of your "peers" is rather meaningless if they aren't actually PEERS.

    Peers - person of the same age, status, or ability as another specified person

    Focusing on the last part... same ability... how would Joe Average have ANY idea about programming, programming languages like Java, APIs, etc?

    How can they legitimately be considered peers.

    So true...

    Under such a idiotic argument, the cost of the new Marvel Avengers movie should be $50, because it costs $220 million vs some other movie that only costs $10 because the budget was $60 million.

    Really? Think movie goers would take that? No... the $50 ticket movies would TANK... plus they'd be pirated and distributed because people do not perceive the value to be as much as it is. In laymen's terms... people don't like to be cheated... and they don't like to feel like they're being cheated.

    eBooks are the publishers way of cheating customers. They take virtually NO money to convert and virtually no money to distribute. I know... I've published both hardcopy books and eBooks.

    I price the eBooks MUCH lower because they don't get anything they can physically hold in their hands AND, it doesn't deplete the stock at all nor cause me to need to do another run of books.

    It's just used car salesmen trying to put one over on you... yup... a little ole lady only read this eBook on Sundays...

    Confusion

    The real confusion is the ability of companies to deceive buyers into believing that you are BUYING the movie.

    If instead, it was VERY obvious that you are not buying the movie, but "leasing" or "licensing" it... people would act differently.

    Currently... they suppose (rightfully so), that buying a DVD is like buying a toothbrush or screwdriver. You buy it... it's yours... you can do whatever you want with it.

    The difference is not plain nor evident that this is NOT the case with intellectual "property".

    It's a big scam that the government SHOULD have put a stop to (since it's blatantly consumer fraud), but which the government is being well paid to ignore.

    Hard to believe I thought he might actually change some thing. Sadly... I hadn't considered that he would change things for the WORSE.

    So typical...

    So typical of the heavy handed policies of so many wannabe tyrants in schools.

    Schools need an overall. Throw out tenure. Throw out the unions. They serve no one but themselves.

    Let teachers and principles all be judged on MERIT. If I did as poor a job as some teachers, I'd be out of a job. In the school system, it takes an act of God to get rid of a teacher, unless they (God forbid) friend one of their students on Facebook... oh wait, an intelligent Judge threw that out.

    Why would the Justice Department want actual JUSTICE, when their Big Media masters just want conviction?

    It's also cheaper just to execute anyone accused of any crime without a trial.

    Doesn't mean we should do... just because it's cheaper.

    Treason?

    So... government officials... including Supreme Court Justices... are sworn to uphold the Constitution. When they fail to do so, they are committing a crime against the nation... isn't that treason?

    Obviously, THEY don't want to see it that way. But I can't help but think that deliberately or in complete ignorance chipping away at the Constitution should be punishable by death.

    I would prefer public firing squad to dissuade others.

    Lesson from the Cold War...

    In the Cold War, there were top level spies who didn't want peace. Why? Because they would lose their money, power and influence.

    Same thing now... only it's the lawyers who gain from mutually assured destruction.

    I'm fairly certain that the signers of the Constitution would personally line up the writers of every piece of Copyright and Patent legislation and introduce them to the 2nd amendment.

    Of course it's infringement...

    "WOW! I wasn't aware that allowing me access to Megaupload to retrieve my family photos would represent infringement. Don't I have copyright over family photos that were taken by me and my family?"

    It's all an illusion... no one but Big Media can own a "piece of the action". Everything in the world that has been, is being or will ever be created is their property.

    The sooner you realize this, the sooner you can just pay them to take pictures of your family, friends, etc. In fact... any pictures that might be snapped by monkeys handling your camera... they also belong to them.

    Good to see...

    In an age where Intelligent Judges or Tech-savy Judges are almost an oxymoron, it's good to see we still have some sitting on the bench who can look at things objectively and in the light of technology.

    Or, at least, the Feds are now effectively the Big Media's enforcement branch... bought and paid for through contributions and lobbyists.

    Sad... but true... the government is no longer by the people and for the people... it's BUY the people and for whomever pays the most.

    Anyone who tells you differently... is obviously paid off already.

    Ok... it was paraphrasing actually... and it's not copyright infringement from The Passion, since it's actually from the Bible... which I believe God left with creative commons license to use as long as you don't modify...

    So... if someone claims copyright on the Bible because they changed something... then... well... their creative commons license is revoked... and they are violation of God's copyright...

    May the lightning bolts and plagues begin...

    Good... and bad... and... ugly...

    Personally, I think it's great that Ian and Stephen put on their big boy pants and stepped in to stop a bully.

    Sadly, this means that the outrage from this type of extortion bullying will diminish and die away.

    As a previous poster pointed out, this Pub has been in existence for over 20 years and somehow, I think they'd be hard pressed to prove that there was ANY affect on book or movie sales.

    In fact, quite the opposite.

    Plus... copyright is on a single expression of an idea. Somehow... I don't remember there being a BAR in any of Tolkein's books called "The Hobbit". Nor do I remember any drinks called Gandalf, Frodo or Gollum in any Tolkein literature.

    As far as using likenesses... last I checked, there were no "publicity" rights in Britian... so if they bought a photo... what exactly would be the law against displaying it? Or, if the licensed a photo of the actors from something like BigStock... the violation is... where?

They cannot do it because they are specifically competing with the same product being given away for free."

    I love how people who know nothing and do nothing try to comment about things they know nothing about by reciting Big Media talking points.

    I am an author. I sell books. I also sell software/phone apps. I also sell CD's/DVD's.

    I have no problem competing against free. In fact, I never both to check to see if my products are pirated... I don't care.

    If someone pirates my books, CDs, apps, etc... that person has a much better chance to become a customer of my other products.

    And if not, big deal... I'm always creating new streams of revenue.

    I DON'T make one thing and then expect to sit back and reap the rewards for the rest of my unnatural life.

    None of the great artists throughout history did. Did Mozart stop after his first symphony and expect to live on it for the rest of his life? Bach? Van Gogh? Shakespeare? Mark Twain? Robert Frost?

    No, all great artists have one thing in common. They kept creating.

    Coincidentally... so do I.

    If you make something people find value in, they will buy it. Will some people pirate it? Sure... but either 1) They will become customers because they like it, or 2) They really wouldn't have been customers anyway.

    Piracy is the excuse of men with weak wills, weak imaginations, weak drive or all of the above.

    And that's from someone who KNOWS... because I DO it. Not because I'm reading some Big Corp's talking points.

    There are and always will be opportunities for intelligent, motivated people to make money.

    Anyone who tells you differently is selling misery.

    For goodness sake...

    Will someone PLEASE patent the idea of patenting ideas and then suing people/companies while never actually doing anything with the idea.

    And while you're at it, patent the idea of patenting stupid ideas by adding "on a mobile device" and "on the internet".

    Don't worry about prior art... the patent office doesn't.

    And, of course, they will blame poor sales on piracy.... not quite getting that the main reason people are pirating their books, is that the legitimate versions are way to cumbersome.

    Just look at iTunes incredible success. Why? Because it's EASY.

    Make it easy... people buy. Make it hard... people find ways to make it easy themselves.
