Swedish ISP Told Not Just To Stop Hosting The Pirate Bay But To Block Others From Reaching It As Well [Updated]
from the overkill? dept
A former ISP for The Pirate Bay, Black Internet, was told by a Swedish court that it had to stop hosting the site a while back. The Pirate Bay quickly switched to a different provider, but Black Internet went to court to challenge the legality of being told whom it can and cannot host. It appears that the Swedish appeals court ruling on the matter went beyond just telling Black Internet that it can't host The Pirate Bay,Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.
Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.
While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

"Update: Court of appeals judge Ulrika Gustavsson Stenbäck has been speaking with Swedish media and has stated that Black Internet’s interpretation of the injunction has gone too far.
“The decision meant no general duty to supervise over what people do online, or a general duty to stop someone from getting into the Pirate Bay. It is clear in our decision. Our decision relates only to Black Internet not providing internet access [hosting] to The Pirate Bay.”
It seems at this stage that Black Internet is blocking The Pirate Bay but doesn’t have to."

Re:
"...not providing internet access...to the Pirate Bay." I'd take that to mean they have to block the site from their customers. [hosting] is different than accessing.
Who put the bracketed stuff in?

Clarify the update - The judge says (from Swedish site)
"Ulrika Gustavsson Stenbeck was one of the three judges who took the Court of Appeal decision. She would not comment on Black Internet action is right or wrong, but saying that there was no requirement that Black would prohibit Internet customers access to Pirate Bay."
Hosting is inferred from?
"- There they are prohibited to do is to provide internet access for file sharing service The Pirate Bay, "she says."

Yup. I had opened the original a while back, and hadn't reloaded it before writing and posting this story, so I didn't see the update. Such is life.

I'm sure some people will run to enact laws outlawing the practice with some convoluted reasoning.
