More than a year and a half ago we were joined on the podcast by Riana Pfefferkorn, then the Associate Director of Surveillance and Cybersecurity at the Stanford Center for Internet and Society and now a research fellow at the Stanford Internet Observatory, to discuss the disastrous EARN IT Act. As you probably know, EARN IT is back, and this week, Riana joins us once again to discuss why it hasn't gotten any better — and might in fact have gotten worse.

Sen Mark Warner dodges answering
I'm a constituent of Sen. Warner, and I asked him if the bill's sponsors or proponents could provide links to studies that showed a causal relationship between the provisions of EARN IT and a reduction of CSAM that the sponsors claim will happen. I got a form response that completely ignored the request: and the problems with the bill.
"I have taken a number of actions to bring Section 230 into the modern age and hold companies accountable for the harmful, and often criminal, behavior enabled by their platforms." Oh, good, so I can hold VA liable for criminals using state-funded roads? I can hold private businesses liable for not having adequate security if I'm robbed when patronizing them? Oh, and my spouse cheated on me in a hotel? I can hold the hotel liable for my marriage failing? What if they met and arranged a rendezvous using BIG TECH? FFS
"...make needed reforms to Section 230 to protect children from exploitation online..." Show me! Stop with the argument that correlation=causation and actually explain it. And stop trying to push the "but the children" button - as a kid, I came within a whisker of being exploited in the 80s and it didn't require the Internet. The fact that the Internet and social media allow the assholes to connect more easily now and to disseminate CSAM is NOT cause for this kind of legislation.
