Representatives with a financial interest should recuse themselves, as judges already do.
Sadly impractical, IMO. Some of these corporations just spread the money around evenly in order to "cover all the bases". If every rep with a financial interest recused, they might not be able to constitute a quorum to vote at all.
So it's a bigger crime to sing one of Michael Jackson's songs than it is to kill him.
Well, considering that MJ was such a unique singer, it is pretty hard to hear covers, wait that's not what you're talking about at all!
Arbitrary sentencing is a common problem when penalties are written in a vacuum of common sense, or under the influence of moral panics and lobbyist dollars. The 18 to 1 sentencing ratio for crack cocaine related offences readily comes to mind.
Sounds like the WWII "enemy" Internment Camps, which we know were so effective and necessary, that now Congress thinks it's a good idea to extend to everyone.
It must be so easy to make these decisions when you know you get to be the one holding the stick.
I disagree. Any Techdirt post that summons more discussion than everyone trying to make OOTB see reason, while OOTB keeps hacking away with borderline nonsense is a nice change of pace.
Re: Re: "you should be able to buy the DVD of the movie you just watched"
It's the truth! I don't go to the theater alot, but there are definitely a handful of movies every year that I go to for the "theater experience:
- Hanging out with friends before the movie.
- Watching the trailers.
- Getting to see the movie in a large, sharp screen, with good sound.
Speaking from my own experience, I know right away whether the movie is "ticket worthy" or "worth a rental". Why make me wait months to make good on a decision that's already done?
I have to agree with the opposition here. As long as the product is legal, a company should have a right to preserve their trademarks on their own product.
Smoking is not good for you, and cancer, to the burning lake with that terrible illness. But a legal product should only have to compromise so much when it comes to how they're identified.
When any product gets to this point wouldn't be simply better to end the hypocracy of considering it legal while making it impossible to consume, and just ban the stuff?
Re: Re: Re: Instead, say YES to shutting down pirate sites.
If you make the pirated content harder to find the legitimate sales channels will see improved traffic.
And the best way to do that is through a non-adversarial process of accusation and seizure that is written broadly enough to be easily abused, taking all sorts of legal and constitutional expressions along with it?

Heck, not only does each artist have an equal chance to succeed, but they get that chance within the current IP regime. I feel like this point is short-shrifted.
You would think that pro-IP folks would be playing this up. Artists have the opportunity to make a living through their work without having to sacrifice their copyrights or artistic control, the first two things a band risks losing they moment they sign.
Then again, when it comes to the "industry", maybe this discussion has nothing to do with the artist and the protection of their content.
Sell products that I want, that are convient for me to use, at a price that makes sense to me.
In the end, if a business can't fulfill that simple axiom, I don't engage in infringement, but I sure as heck don't buy. Details are a problem for the busniness, not for me as a consumer.

That's pretty much the gist, right? I have two points:
1. It's useless because you can't really determine the clicker's intent for clicking on the button. For all we know the reporter is a troll or bigot.
2. It's redundant because if the site/post is really of concern, you can just call the cops. It's smarter IMO to truly know who's reporting, and their reason for doing so.
The only way you might possibly win, at the moment, is not to play: and even then, that might not be good for the future of America.
I may be misremembering my college history, but I swear Lenin said something to this effect:

For all of the complaints about how bought off the system is, and how our politicians are simply listening to moneyed interest and their lobbyists I think that people have to continue to be vocal about their opposition. Do not give the people who crafted and support this bill any reason to say that they never heard any objection to it.
