...and recuperation of legal fees, time equivalent related to her having to go through this process, and force Universal to audit, monitor, and report on its ability to rectify this problem permanently...

Not at all. See the whole Spamhaus deal. The right to maintain a list is there, any group can blacklist any other group, and the public is free to follow or not as they see fit.
The problem with that analogy is that spamhaus isn't blacklisting other spam blocking services. To me, one advertiser/media company trying to blacklist those who do now, and in the future may be competitive to its business model merits some scrutiny - or at least a challenge of some sort in the courts.
If this site is in fact not guilty of infringement, then GroupM and others maintaining the "pirate list" are guilty of this offense and should be sued mercilessly in court...
There are only so many notes, played in specific ways that are pleasing to the human ear. This means that any new creations have to, and will, be built from the work of others - that is fact and further, there is no music from the past that didn't rip something from the artists that preceded them.
All this is, is someone charging rent because they are too lazy and apathetic to get off their rear-ends and actually create something, even if it is just a reinterpretation of something from the past...

Well worth the watch and not a bad idea to brush up on history now and then. As has been shown again and again...history repeats even when we remember it ;)
If you can't see the parallels here, I suggest you brush up on your US history (circa 1920-1933) to get a grasp of how this issue is likely to end eventually.
When the population gives no credence to the law, it breads contempt for the law and that is bad no matter what side of the issue you are on...

The British already tried what you are trying to push with Protect IP. They even tested their version for about a year and found it totally unworkable and a detriment to innovation and small businesses.
