If this is a report and recommendation, then that means the magistrate handled this motion and has now made this recommendation to the District Judge, who will issue a ruling after the U.S. Attorney has a change to respond to the Magistrate’s recommendation. So there’s still a long way to go for the defendant. The District Judge doesn’t have to accept the recommendation.
Are we sure the police even know about this law? I mean, until there’s a court decision that very specifically states with no ambiguity that all property seized has to go to the general fund and not into the pockets of the police, how are they supposed to know what the law is?
