I'm not totally sure that the game was worth $40 either...I'd probably go with a price closer to $30, but it was pretty good...and it definitely has replay value...unlike a lot of games out there...I would like to see some more improvements...maybe something like an extra character or two...that would definitely up its value tremendously (if it was two extra characters, I might even consider the upgrade worth PAYING for)...but I also was rather impressed with Stardock's attitude on the matter...and rather upset with GameStop's rather unprofessional actions...nevertheless...it IS worth noting that the NPD numbers only represent store-bought copies of the game...they don't include Impulse downloads.
Nobody mentioned their entitlement to free music except you (and possibly another Anonymous Coward, if you aren't one and the same...). Even if a few believe they are entitled, you sound like an idiot because you have extended that to everyone else who doesn't.
And, it just makes people like me who don't download music illegally just that much more supportive of those who do because we sympathize with them.
@ Jeffry Houser - Actually, neither copyright situation applies in this case - as Ima Fish noted, the sporting event in and of itself is not copyrightable...only the broadcast of the event.
In the meantime, one of the company's founders has written up something of a post mortem, where he suggests that only 4% of their installs early on where "completely silent," but doesn't note how many weren't necessarily "silent," but were done through trickery or a lack of full info.
You may want to change the spelling of this word...it's pronounced differently than what I think you intended (were)...it's not a big deal to me, but since someone already started the grammar corrections, I figured I'd help out a little...this was the only one that really even stood out to me...cuz I had to reread the sentence to understand it...I completely missed the other errors.
My roommates have never been big on file sharing (though I have a new one who torrents day and night...we're gonna need to have a discussion about sharing bandwidth...), but upon hearing about the whole Pirate Bay fiasco have actually become extremely interested in the whole file-sharing issue...perhaps this will cool down sometime in the future, but, for now at least, I think people are becoming extremely aware of the predicament that big-industry has placed them in and they are becoming concerned and upset as a result.
If you read the warrant application...there are only a couple of examples of evidence that actually even refer to the actual crime being checked out...the crime is actually the harassing email. According to the warrant application, the system admins pointed the police toward Calixte's IP address...and according to the police's interview of the defendant's roommate, the defendant is a hacker. Basically. The only evidence they have is that his IP may be involved...beyond that, they have a witness that claims that he hacked a whole bunch of stuff completely unrelated to the case at hand, including his own computer (which no expert can corroborate). That's, first of all, not prosecutable in this specific case. Second, the witness says nothing about seeing his roommate send the email. The only evidence the police have is circumstantial evidence - they know that the emails sent had tags tracing back to Calixte, including two distinct linux computer names, and the roomate stated that his roommate uses two different operating systems, and one is called bootleg something or other.
While certainly suspect, this evidence is, at BEST, circumstantial. Most of the evidence/basis of probable cause is completely irrelevant to the case at hand.
This IS SCARY. I for one have spent plenty of time goofing around with my various systems, playing with settings, trying to break stuff. My roommates are clueless about what is going on. I do my best to at least explain to them what is happening so that I can maintain their trust, but what's to say that they won't become scared of something that they don't understand and start thinking that everything that I am doing is hacking? Pretty soon I could end up on the bad side of an investigation myself...I don't really do anything illegal that I'm aware of, but I could potentially be the victim of some targeted attack. That could be everything needed to set a whole bunch of events into play, just like this situation, with me at the center.
This isn't emotional for me. It's just plain thinking about the consequences of actions and precedents. While I certainly wish some days that our government had more ability to prosecute and investigate, I realize at the same time that the powers that are given to them are liable to be abused...there MUST be careful balance...in this case, I think that the judge made a grave mistake and the EFF is very correct in defending this guy, whether or not he is guilty when all is said and done.
Maybe you should think before you post. Instead of filling your posts with diatribes against the rest of us, try putting some references and facts in. Oh, and toning down your tone to a conversational one would help in convincing the rest of us that you aren't emotional.
Don't these people learn the lessons from their own movies?
So, I was reading this and had this random thought...
All the younger generation people get it just fine - Pirates = GOOD, following laws that don't make sense = BAD...
You'd think that after milking the general public off of 3 Pirates of the Caribbean movies, they would have figured out that they shouldn't call unauthorized sharing piracy...all the 13 year old girls think that those that do share are pirates...but that's ok, because pirates are way hotter than those other guys...
I'm just curious...did anyone in the recording industry notice that they made their scapegoats into heroes? Not only did they falsely accuse them of ruining everything, but then they exalted them in their own movies...Now THAT's what we call WINNING strategy there!
Ya...especially when you can buy some of those tools from the local hardware store...now, realistically, you probably won't be able to get the manhole key for the local fiber-optic cable repository, but it probably wouldn't be that difficult to create an appropriate key in a machine shop...or modify a similar one...
@ no tech, only dirt - I'm sorry this is such an emotional problem for you. Quit trolling. The point that's being made here is that it doesn't matter whether or not the defendant is guilty or is trying to block proceedings. The point is that, if the police can file and get a warrant on baseless crap like this, then it could happen to you and me too. That's SCARY.
Get on topic and stop attacking people ad-hominem.
dang...I knew air was hazardous to my health...guess I'll have to turn to more acceptable methods to keep this impending weight off...bulimia or anorexia...
DMCA takedowns have been so abused and copyright holders have been so promiscuous in filing expensive lawsuits that companies can't afford to bank on Safe Harbors actually protecting them. THIS is the problem. When the government can't even protect its constituents, then we have an issue...
I'm not saying that we should drop sports just because it doesn't bring money in. But I do agree with snowburn inasmuch as I feel that colleges need to do some serious reevaluation of their priorities. Personally, a college that I just graduated from has a horrible athletic department. Only one sport, basketball, is even competitive (though I think the women's soccer team was somewhat competitive 5 years ago). Does this mean the sports department should be disbanded? Heck no. But the school is building an entirely new sports facility to replace the old one. The building is expected to cost roughly $10million. The Music Department had $1million in funds SPECIFICALLY DESIGNATED toward refurbishing the recital hall (they needed it...the recital hall was a piece of crap that was built in the 60s...and it was falling apart).
The music department is actually one of the biggest magnets of the school, especially the choirs. Yet, someone in administration appropriated the funds from the music departments account, stating that "they were needed for more important things". This was the final amount needed to start construction on the new sports complex. Needless to say, the construction on the recital hall that was ALREADY in progress and almost done had to be immediately halted.
Good thinking there...
There was quite a bit of a debate that occurred around the campus and the only reason that the music department got the funds back was because someone on the School's Board got wind of the matter and fired the administrator for fraud.
Point is, that for a school where the athletic department gets about 40% of the school's budget but can't bring in that much (basically...a sinkhole), it's rather ironic that the rest of the school would be funding this department from their own budgets (I was in the small chamber choir...we pretty much made the entire music department's budget for the year (scholarships and all) in the 5-day tours that we took...Alumni liked us...and they were rather well off)
@Anonymous Coward & aguywhoneedstenbucks - I agree that there is nothing wrong with posting as Anonymous Coward as, yes, some people need to keep their identities hidden. That's perfectly fine. But I think it is important to realize that those who post with a name/handle of some kind inherently have a more identifiable and, therefore, stronger voice. The handle allows everyone else to associate a character and voice with the person, lending them credibility and a personality. Just as you would pay less attention to some random guy on the street trying to tell you something than you would to your buddy right next to you, you also give comments on the internet a little longer of a glance and a better read when you can see that they posted with a handle. It's partly a trust thing.
A handle DOES make a person more identifiable on the internet - it's roughly the same thing as me giving you my name at a party...while it's not enough for you to track me down and show up at my house, it does identify me enough for you to have a conversation with me.
There's nothing wrong with anonymous speech...I do agree with that...but I do think that people really do need to understand just how their speech affects others...and part of that is in HOW they address others...
Actually, from what I read, the exact opposite is true...only a select few universities actually profit from their Athletic Department. The rest sink millions into the department just to be competitive.
