On a US hosted web server, it's not illegal to say "communism sucks", however that might be illegal on a Chinese hosted web site. Should the US allow my extradition because a Chinese citizen read my post?
Or more accurately, I'm in country FooBar and our country doesn't acknowledge US copyright. Should the US have the RIGHT to charge (and extradite) me if I have a web site that has a song for download that is copyrighted in the US and a US citizen downloads?
Should all countries be subject to other countries laws on the internet? Be careful how you answer!
Since the new law distresses me and it's posted, does that mean that all of the TN legislators need to be jailed or just the poor sob that had to publish it? :)
So, before Roger Ebert was well known (ie, when he "really wasn't a journalist" yet), any bad reviews he gave were illegal if he included a 26 second clip in the review?
That fails both the smell test and the definition of "fair use" under copyright law.
Guys, many of you are missing the point of this post. What is being reported here is the misuse of a DMCA take-down notice to get the video pulled. It's REALLY not about whether the guy making the video was right or wrong.
Think of it this way... You own 40 acres of prime Florida land and I want to buy it. Why can't I use "eminent domain" to force you to sell it? Because while eminent domain is a valid option in some cases, it's not valid for me to use it that way - just like using the DMCA to pull down this video isn't valid when used the way it was used.
All of the law abiding RIAA executives and capitalist lawyers should quake in fear of the Russian Communist propaganda! CopyRIGHT is the RIGHT of big business to make money off of the creator of content - without that RIGHT, the music industry would fail and life as we know it in the US would cease to exist.
You are licensing the right to a CD that has a copy of THEIR content on it. All you OWN is a piece of plastic, they own the music. Or at least that's the way they want it (and maybe what you "agreed" to by opening the package).
Michael Geist has an article describing the Canadian Copyright Collective's desire to "tax" SD cards. The plan is:
50¢ for each electronic memory card with 1 gigabyte of memory or less, $1.00 for each electronic memory card with more than one gigabyte of memory but less than 8 gigabytes of memory, and $3.00 for each electronic memory card with 8 gigabytes of memory or more
I guess even blank memory cards and blank CDs are potential pirate media. Maybe we should all just go back to listening to LIVE local bands. Oh wait... ASCAP would taxes that too.

In law, the goal should always be to avoid setting bad precedents. They have a way of coming back to haunt you!
