Since the clip is newsworthy, wouldn't it qualify as fair use? Despite the fact that I haven't watched Letterman in years, I've seen plenty of excerpts from his confession on CNN and other news shows. Did they get permission from CBS to air the video?
Politicians get investigated all the time (remember Eliot Spitzer?), but I'm sure the police get warrants and make sure the paperwork is double-checked.
In regard to collections of facts, O'Connor states that copyright can only apply to the creative aspects of collection: the creative choice of what data to include or exclude, the order and style in which the information is presented, etc., but not on the information itself. If Feist were to take the directory and rearrange them it would destroy the copyright owned in the data.
The court ruled that Rural's directory was nothing more than an alphabetic list of all subscribers to its service, which it was required to compile under law, and that no creative expression was involved. The fact that Rural spent considerable time and money collecting the data was irrelevant to copyright law, and Rural's copyright claim was dismissed.
WOW has two components: software that runs locally, and a private network. The local software is owned by the user and they can modify it if they wish without violating copyright. However, when they connect their modified software to Blizzard's private network, they are violating the terms-of-use of that network and Blizzard is within their rights to kick them off. There is no need to invoke copyright law.
Newspaper intentionally overcount their print circulation numbers so it's no surprise that they overcount their web hits as well. Newspapers make the majority of their money off advertising. To get the best advertising rates, they need to show good circulation numbers. They do that by offering 1 month free subscriptions to "try out" the paper. They do it by dumping stacks of free newspapers in coffee shops, fast food restaurants, etc.
