Well if they are going to tax you based on speed it's prob because you are capable of downloading more files. I'm not saying it's a good idea but if it did go through there should be guarantees they you would not get sued for infringement.
As far as blueray goes. I would rather keep my files in digital format and view them over the network. With drive space becoming so cheap why should I invest in another format that is more restrictive? Not to mention there less plastic recycle.
Even if you could trademark those other things how could you trademark Design/Develop? Looking at there site, some stuff is obvious and most stuff is just confusing. All they are doing is branding their services... nothing new here.

I'm no legal expert, but aren't the punitive damages about making sure the defendant is taught a lesson to not break the law again and not to teach others a lesson? Sure he won't infringe again but I'm sure $10,000 would have been more then enough. Effectively bankrupting him won't help deter others. Also he could just go bankrupt and I'd love to see how they would see a penny of that money now.
In open source communities this guy would be rewarded. It's the hard work of finding and correcting a flaw at no cost to the project maintainers that keep things free and secure over closed source projects. The kind of security hole this guy was talking about is not akin to leaving a door wide open. It's more as if you tell me you have the best lock and it's secure but I tell you I can jimmy it open. You don't believe me. So I jimmy open and figure out how to protect it from being jimmied open again then leave you a note letting you know how to fix it. While I'm sure I could still get arrested for breaking and entering there are some issues where it's better to have these kinds of people honest and let you know. I'm willing to bet that many others knew of the loophole and just used it without telling anyone which is the real danger.

to me running advertisements are a loss leader. According to your logic I should charge for people to view the ads. This is asinine are best. Google wasn't the first to offer free maps. They should include map quest, Microsoft's maps, Yahoo!'s maps, and just about anyone else who offers free maps.
Getting movie listing is one of the best features of the Google App for the iPhone. You just speak "movie times" and it will list movie times from theaters physically near you.
If they are going to make the content in a walled garden then it should be ad free. Why are people paying upwards of $150 a month to get bombarded by ads. I can understand ads on publicly available sites. It wouldn't take long for someone to setup a VPN to watch this content remotely.
Basically this should be ad free while you are on the cable network and ad supported off their network. They need to make this so easy for the consumer it makes setting up a private web server with self downloaded content a hassle in comparison.
This is why Hulu would have probably beat tv-links.co.uk if it were still online. Give people a legal way to reach this stuff easily.
I wonder if amazon gets enough business from affiliates to care once every state has been blocked. I think the proposed changes are stupid, but is this the right business move?
