Imagine if courts merely entered an order that if you cut & run you will pay any and all legal fees to your target. Getting legal fees is possible, but the courts have been loathe to award them to defendants who end up spending 5 times what the settlement cost was only to have the troll cut & run.
An IP allegedly points to a location & they claim the person whos name is on the bill did it or is responsible.
Except billpayers can't be responsible for the actions of others, & its REALLY unlikely they told a family member or guest 'ZOMG STEAL ALL THE SHITTY PRON!!!!!!!' so they have no liability or duty to the trolls.
Civil matter, yet somehow a series of numbers allows them to demand depositions, full access to online accounts, & forensically sound imagines of every device in the home & pretend any resistance is evidence of guilt, because if you are innocent you'd let us turn your entire life upside down to prove it.
What are the odds a cop could get a warrant to search oh say Trump Tower from top to bottom based on we saw a white dude we think did a bad thing walk in. We might find the dude we thought was guilty & discover he was innocent but we totally should be allowed to go to every floor & in every room to see if there is any crime there... because we saw dude walk into place.

We can't import drugs from other countries for 'safety', lets ignore these are the same factories that make the pills for US sale.
We give a benefit to companies willing to make 'orphan' drugs & then ignore the 3000% price hike.
We pay to develop drugs & then hand all of the profits to a corporation b/c they had to pay for 'testing'... that is done in-house and sometimes is faked & kills people... they might get hit with a fine later as some states have actually passed laws to protect drug makers from lawsuits.
We live in the corporate states of america.
Look at the model & then note how many of our laws that are supposed to benefit us only benefits them.
We grant, for a limited time (HA!), the exclusive rights to the thing. At the end of that limited time, it enters the public.
IP is the drug of corporations.
We've given exclusive rights to cell companies, cable companies, phone companies, drug companies and more... and despite the fact each one of these sectors have fscked the public over & over we let them keep going.
Perhaps if we stopped giving power to leaders who are lining their pockets & just voted for anyone but incumbants until we put the fear of the people back into Government we could get better results, but as it stands now we vote for those swearing to protect us from the bad things, that they then inflict themselves if it makes them a buck.

They think insulin is gathered from the sex organs of flowers that only bloom under the full moon 1 time every 100 years & its not gouging.
They think adding some buffers so they can call it extended release is innovation worth patent extensions.
Some dude effectively rid of small pox, another got polio and made a buck. Every asshole since then has been making not just a buck but 1000 bucks.
Oooh research!!! Which seems to be focused on researching ways to make the advertising more effective at getting people to 'talk to their doctors' about the drug to get on the newer only slightly better drug with the 50x price hike.
I mean its not like a drug is available outside the US for $22 but in the US its $20000... oh wait.
But we have these awesome programs where if you can't afford your medication the company might be able to help... they only reason they do this is good PR and probably because they get a nice tax write off.
The profiteering is obscene (even worse on the drugs developed with public funding) but what is more obscene is government unwilling to anger powerful donors as we literally have people dying b/c it was get evicted or buy insulin. Other than it might cost them some money to put security into place, is their any good reason for allowing this to happen?
Perhaps if the courts decided they were at fault when customers were robbed with assistance from their employees/contractors/sub-contractors (which are just dodges to avoid responsibility & benefits), they suddenly might discover they had the power to protect consumers all along.

The fix was because Kashmir Hill called them out after this farm family in the geographic center of the US was screaming for help. They were harassed at all hours of the day & night by people who looked up an IP, where sent to the location that had nothing to do with the IP address. After Kash figured out what was happening & publicly shaming them, they then moved it to the middle of a lake. I wish we had a camera to see how many angry people roll up on the lake still.
After this event, MaxMind claimed they fixed these things... except they missed a few, and there was the family in South Africa who had been arrested over IP 'evidence' that could never be wrong... except when it was wrong. IIRC the mapping was flawed b/c they used data provided by the military.
An IP address might point to a geographic location within a courts jurisdiction, while this is a civil matter & not as stringent as a criminal matter one has to ask if the idea of 'we saw a blue car, we want a subpoena for the DMV to tell us who registered a blue car in a 100 mile radius' one might ask if thats a bit of a stretch.
An IP address can't tell you who was using it, instead they ask to get the name of the person who pays the bill. They then accuse the billpayer of being the infringer, then if it doesn't fit the narrative, they look for someone in the home who owns a penis to blame. It is a legal proceeding and the accused (even if 1000% innocent) still needs a lawyer to avoid being recruited into doing the work for the troll. They accused you, they claimed you did it, & now they want you to give them a list of possible suspects. Gee this case doesn't sound that strong anymore.
Some Judges allow them to take discovery against people accused, which just serves to annoy the target & run up costs to where just settling is the cheaper option. I enjoy the story about the troll who demanded a forensically sound image of the targets hard drive... they returned it to the target, then filed a motion to get the drive back because in the months they had had it.. they never had the expert look at it. They told the court the drive would totally prove their case... yet never even looked at it??
When the expert finds nothing, they don't give up, they claim a lack of evidence is evidence of guilt & they used a super secret method undetectable by their expert to delete the evidence. If this was possible, why demand money for an expert who can only look at the closed box & say 'the hard drive is both alive & dead in the box'??
They get access to social media accounts & claim they liked a post on a topic somehow related to the content & ipso facto they are guilty. These cases are without merit & merely are a $400 down payment to obtain thousands of dollars by harassing targets with 'legal' maneuvers designed to upset & ruin the reputation of someone who merely pays a bill. No wonder they rake in cash, as courts still seem to think lawyers are truthful & aren't lying to their faces.
MaxMind is 95% accurate and I get all the pussy...
Statements hold up until you look at the actual facts that MaxMind doesn't actually claim that and a clerk just visiting the website could disprove it... just like it would take a clerk about 30 seconds to discover I'm the gay one & a Gold Star Gay at that.

I saw this on teh Twitters & asked Kashmir Hill if MaxMind had 95% accuracy... I think she fell out of her chair.
MaxMind is the company that has sent people to a farm in the middle of america to get back their 'stolen' goods b/c IP's resolved to a dead point in the middle of America that happened to be on this farm.
Same thing happened in South Africa.
Same thing happened to nice people living in a house flagged by MaxMind as hosting IP's for prolific phone thieves & they got visits from really rational people who completely understood MaxMind isn't accurate like that... snort
MaxMind doesn't tout the numbers claimed in court, and infact the certainty % drops the smaller the area you zoom in on... like a single district...

This is the very clear message we are getting from the courts.
The unions scream about the 'war on cops' & express how upset they are when people call them names... yet remain silent when officers fail to do their jobs or violate the law resulting in the death of citizens.

An IP address might point to a geographic location within a courts jurisdiction, while this is a civil matter & not as stringent as a criminal matter one has to ask if the idea of 'we saw a blue car, we want a subpoena for the DMV to tell us who registered a blue car in a 100 mile radius' one might ask if thats a bit of a stretch.
An IP address can't tell you who was using it, instead they ask to get the name of the person who pays the bill. They then accuse the billpayer of being the infringer, then if it doesn't fit the narrative, they look for someone in the home who owns a penis to blame. It is a legal proceeding and the accused (even if 1000% innocent) still needs a lawyer to avoid being recruited into doing the work for the troll. They accused you, they claimed you did it, & now they want you to give them a list of possible suspects. Gee this case doesn't sound that strong anymore.
Some Judges allow them to take discovery against people accused, which just serves to annoy the target & run up costs to where just settling is the cheaper option. I enjoy the story about the troll who demanded a forensically sound image of the targets hard drive... they returned it to the target, then filed a motion to get the drive back because in the months they had had it.. they never had the expert look at it. They told the court the drive would totally prove their case... yet never even looked at it??
When the expert finds nothing, they don't give up, they claim a lack of evidence is evidence of guilt & they used a super secret method undetectable by their expert to delete the evidence. If this was possible, why demand money for an expert who can only look at the closed box & say 'the hard drive is both alive & dead in the box'??
They get access to social media accounts & claim they liked a post on a topic somehow related to the content & ipso facto they are guilty. These cases are without merit & merely are a $400 down payment to obtain thousands of dollars by harassing targets with 'legal' maneuvers designed to upset & ruin the reputation of someone who merely pays a bill. No wonder they rake in cash, as courts still seem to think lawyers are truthful & aren't lying to their faces.
MaxMind is 95% accurate and I get all the pussy...
Statements hold up until you look at the actual facts that MaxMind doesn't actually claim that and a clerk just visiting the website could disprove it... just like it would take a clerk about 30 seconds to discover I'm the gay one & a Gold Star Gay at that.

I saw this on teh Twitters & asked Kashmir Hill if MaxMind had 95% accuracy... I think she fell out of her chair.
MaxMind is the company that has sent people to a farm in the middle of america to get back their 'stolen' goods b/c IP's resolved to a dead point in the middle of America that happened to be on this farm.
Same thing happened in South Africa.
Same thing happened to nice people living in a house flagged by MaxMind as hosting IP's for prolific phone thieves & they got visits from really rational people who completely understood MaxMind isn't accurate like that... snort
MaxMind doesn't tout the numbers claimed in court, and infact the certainty % drops the smaller the area you zoom in on... like a single district...

This is the very clear message we are getting from the courts.
The unions scream about the 'war on cops' & express how upset they are when people call them names... yet remain silent when officers fail to do their jobs or violate the law resulting in the death of citizens.
The real law of the land is if we decide you are a bad person, bad things can happen to you. You have no rights & no actual recourse b/c the image of the cops matters more than your life.

Look at all of the blogs they got the FBI to take down on their say-so, never turned over alleged evidence of crimes, courts saw evidence the label supplied the music & authorized them to post it online... the government still held onto the domain & servers for months after they knew they had been lied to.

They gave them ContentID, they accepted DMCA notices & acted on them despite that not actually being in the law (because they don;t host it, just index it).
You might think the courts would totally understand all of this & rule correctly... I would ask have you recently suffered trauma to your brain. Courts routinely rule wrong on tech b/c no lawyer would ever lie to them & they are often to old to give a shit.
