I'm fairly interested in following this particular part of the case even though I'm not an American. What I find most interesting is that the claimants feel their own steps to avoid copyright infringements in their own forums are suitable, but then say those same (similar) steps on someone else's forum aren't?.

Boiling water to make instant coffee is pretty standard practice. Instant coffee (not really coffee in my book) made with water that hasn't been brought to a boil is digusting, just like coffee out of those coffee machines. ugh - barely warm.
120 degrees is not near hot enough to make tea, coffee or even hot chocolate, nor is 135 degrees.
Sorry - not trying to be obtuse, but really...boiling water is how you make hot drinks, unless they are brewed drinks, like in a coffee brewer.

It would be interesting to go look up the temps of our favourite coffee shops here...might have to go do that for curiosity's sake :)
The coffee was ~185 degrees, coffee at home is normally ~135 degrees.

Interesting. The coffee at my house brews at 192 degrees - it says so right on the coffee pot. Instant coffee is 212 degrees (the boiling point of water), so both instances are hotter than McDonalds coffee.
No idea what coffee shops brew at but 135 would be lukewarm.

I agree the defendant is entitled to discovery - I don't see that as being an issue at all.
What I see as the issue is people simply assuming a picture of anyone represents their current state - physically or mentally.
If you read the documents the reason he included Google is because he's requested removal of the blog post (Blogger has provisions for this) and they haven't done it. Probably because he couldn't satisfactorily backup his claim. Without reading the actual blog post...if the defendant's post is "opinion based" Blogger won't do anything about it. People are entitled to their opinions. Either that, or they simply haven't gotten to it yet. This is only Sept. and the blog post he refers to is dated August 2010...it usually takes Blogger a while (long while) to get to this sort of thing.
And he may think he can get some money out of them...$110,000 seems like an odd amount to select...tuition maybe? Or the yearly salary of a lost job?
That whole thing is ridiculous. I actually believe in copyright (not as it currently stands however), but I wouldn't agree with AC - frankly I don't think students should have to pay any fee for using copies of anything if it's for educational or study purposes.
I'm no writer, but when a student or teacher contacts me for permission to use my images, they not only get my permission, they get a letter of authorization that allows them to reproduce whatever they asked for, so long as it's for educational or presentation purposes.
As for the linking...huh? Crap. Anyone can link to my site (yes, copyright contents) for no fee whatsoever, and why the hell should the AC collect any income from THAT? It's my site, not theirs. Thanks but no thanks. I am an anti-violence type of person, but I might join in if someone decided to stone the AC.

I gotta wonder sometimes...progress is not always necessarily better. Take the cell phone (literally - take it please)... people actually expect you to have it with you and ON all the time. And to be honest, if I am outside or on the boat or shopping...I don't want to be answering a phone. THAT'S why I go out - to get away from it.
My cell sits in a drawer...turned off 90% of every year I've had it.
PS: I hope NEVER to have a video phone...people do NOT need to see me in my jammies at 3:00am when they call the wrong number looking for a taxi.
