1. Yes, because it has been reprinted so many times. The only difference here is that "reprinting" a digital file is much easier, you just make a copy.
2. I don't think a profit motive is necessary. You don't think that there will be "hackers" in the future?
("Hackers"=the type of person that just want to know how things works, and make it work better by as an example remove DRM.)

The question on my mind is this; to what extent does this crazy liability extend beyond their borders? Can a rightsholder/"rightsholder" go to court in Germany and have me in Sweden found guilty? Consider that they have used their beloved European Arrest Warrant for just about anything, what's to stop them from using it in this case?
What does it matter? So what if the IP-address was "assigned" to her, since she didn't have a computer or a router, how could she have been the one that did the pirating (if it did happen at all)?
My first thought was that EA and the others would be much harder to boycott than GoDaddy, and perhaps everyone is jumping on this story because it means that they don't have to feel guilty about not boycotting EA, Sony and Nintendo.
(Why would it be harder? Since there are tons of companies out there that offer the same service as GoDaddy, but none the offer the exact same products as EA, Sony and Nintendo.)
I thought they meant the server-side code, as in PHP or perhaps even the actual source code for the webserver. And that would have been an impressive feat.
