No I think what most of us take away from this is "If you see a problem, come back after routing through some proxies and exploit the problem to its full potential."
After all, if your going to take the fall you may as well do the crime. You also might just end up rich.
I actually wonder if any car thief has been charged with that yet.... A lot of the new cars now have the fancy computer controlled ignitions where you no longer use a key. So I would think you could probably get slapped with a computer hacking charge for defeating that system and cranking the car.
Yes, it probably would. Lucky for me I have never claimed to be good at English and being knowledgeable about computers does not require being good at English.
I grew up in a house that always had a PC. The reason being? Well my father worked as an engineer for a computer company in the 80s. As he put it, "Macintosh assumes you are stupid, sense I'm not stupid I don't like them."
So pretty much this is just continuation of their stand point from the beginning. Apple just assumes their users are brain dead idiots and treats them as such. (And having now spent a couple years working with die hard Apple cultist... I can see why they assume their users are stupid)
You know what though, sometimes if you look past the crazy ranting, you can find glimmers of a good idea in some of these posts.
That is to say, I think it would be fun to look through history and put together an example of what copyright law really should look like. Basically just consolidating all the ideas scattered across the site into one concise "Here it is"
Would be very interesting to see, something to dream about and push for. So nice goal to strive for and for those trolls it would be one of the most frightening posts they ever see.
"This strikes me as a huge longshot for a variety of reasons"
You know, I for one am happy to see any effort made to swing back. Sure this might be a long shot, but if it is really pushed then at the very least it is another thorn in the side of those abusing their power.
What is great is that you are rallying for this system on this site... You do realize that your going to get your six strikes within a month or so because you come here right?
Wow, thank you for that incite full comment. Perhaps would do some good to stop and really consider things here, like who is really "ruining it for the rest of us"
You want to point and say the pirates are ruining it and yet these copyright industries cant even keep their own networks clean. So they expect a small business to monitor and control their network when the big movie studios can't even control theirs?
Here is something else to think on. What about the company that does their best to secure their network and still gets these strikes? After all, a lot of us "filthy pirates" are only slightly annoyed by wireless security, it rarely will actually stop anyone.
I think your a bit mistaken. After all, why do you think programs like VLC keep putting out updates? The video formats are not changing that much, and a lot of updates don't add features.
It is not common, but it is not impossible for someone to make a "movie file" that is really a collection of malicious code written to exploit a flaw in a video player.
"law student who believes everything he says, even the stuff that contradicts the other stuff."
Isn't that just a basic part of being a crooked lawyer? Being able to believe your own lies wholeheartedly even when they go against other lies you hold onto.
Re: Re: Re: "cannot be allowed to continue" -- AND YOUR SOLUTION IS?
Yeah, like I said, it was one simple suggestion. It would probably only be a temporary fix until they did like you said and spawned some shell companies. I think in the end though it would still be a good start as even using shell companies they have something to loose.
Well, let me see if I can translate this into a form your mind can grasp.
They are pointing a finger saying I stole something of theirs because my IP address was linked to it. They think this is enough evidence that I should be punished. They do not care that it could have been any number of people on the network.
Now on the flip side, here we have their IP address clearly linked to the exact same activity. So if we apply the same logic to them that they apply to me, it means they are also guilty and should get same treatment.
Re: "cannot be allowed to continue" -- AND YOUR SOLUTION IS?
Here is one simple suggestion. How about a law stating that if you sue someone for patent infringement and you loose then you are responsible for ALL court cost including paying for other sides legal expenses.
The result of this will be that over night frivolous lawsuits will vanish. It will make it so that the only people going to court with patent cases are people who are reasonably sure they have a real case.
If you might end up on the hook for the court costs then your not going to go strutting into court with some worthless patent you twisted and did some advanced yoga moves to try and make look like maybe someone might have possibly infringed on.
So let me get this straight. I will translate to physical objects sense you guys love to say it is "stealing".
What you saying is that sense there is a candy theft issue it is OK for someone to put out a large candy bowl saying "Free candy" and then slap the shit out of anyone who dares touch a piece?
It is really sad to see Nintendo trying so hard to cling to their DRM that they might well kill themselves with it. The thing is though, if you look through their history that is something they have kept a death grip on from the start.
Ever notice that almost all NES games are in the same grey cartrages? There are a few special ones like Zelda that were gold. This is because they had DRM preventing someone from making unapproved games. Nintendo had strict control over the game market and only allowed a certain number out in a year. Of course even back then someone cracked it and there were several games made without Nintendo giving the OK.
So really there is nothing new here. It is just the frantic flailing of a company realizing it has lost one of its most loved possessions, total control over their system. Maybe they will realize that they never really had that and embrace a new world. I sadly doubt it though, more likely they will just die a slow death.
You really should take some time and watch Red verses Blue. Yes, everything that happens is things they "programed to happen", but that show is still totally new.
Well, a really good example of this in practice is Red Vs Blue. A show made entirely in Halo. So who really has the rights to it?
There is the group that made the game. They made the character models and the world it takes place in. The show though is something totally new though. They just built upon Halo as a base.
It stifles competition by granting a monopoly on a work. This prevents any others from using it or distributing it. So in that way it prevents competition. The copyright holder is only one who can distribute or use the work.
Now like I said, This CAN BE good, but is currently being wildly abused. It is stifling of competition all the same. Your preventing the copyright holder from having to compete with anyone else to sell copies.
