IANACL, but taken separately his arguments may almost have some merit. If someone allows use of copyrighted material for free, when they normally charge for it, I could understand the argument that it is a contribution (exception- material covered under fair use). This is not the case here, though, as the material is not used with permission. Analogy- if I own a convention center, and allow a political party to use it for free, it should be a contribution. Dion's argument in this case is more like they just walked in to the center and started giving speeches, when they're actually in the public park (fair dealing) next door. Doesn't make much sense.
What if I download my songs to a RAID-5 array of X tiny USB drives, and then sell all but one of the drives to someone one at a time, restoring the array between each sale*? It wouldn't be practical, but it would be fun to watch the judge's head slowly deflate as the technical details were assimilated.
*Note- with a RAID-5 array, the purchaser could extract the missing data on the last drive from the X-1 drives they have.
Only until their contract runs out. They'll all be free agents then, and are expected to go to different teams. The Marlins will have no fans then, except for any that they draft out of the college circuit.
Ashamed to be an American? Never. Don't let the enormous number of good deeds done by uncountable Americans be negated by the acts of these few morally bankrupt idiots.
Ashamed that these jackasses masquerading as public servants are? Deeply.
IANAL, but how is such a wanton display of a lack of morals, a blatant disregard for justice (and the law by reference), and brazen dereliction of their duty as prosecutors not sufficient for review for disbarment or criminal charges?
This is just a bit above nuts. This is one Chubby whose stature would have been improved by a bit of circumspection. Instead, he got a big rise from this Palm app. But when the cold wind of reason hits, hopefully this will all shrivel up to nothing.
Does this include all navigable waterways? Notice that they included the borders of Lake Michigan, which is entirely within the US. This would also include the Mississippi river. Does this mean that the DHS wants to paint a yellow stripe down the middle of the country?
Would this count for a work-for-hire by Beyonce? I'm assuming she was paid, or volunteered for this work. IANAL, so can anyone say how this would affect the copyright status?
I don't think the author is helping himself by doing a good translation of his book. My first guess as to how this works is:
1) Book is translated into Russian (or other language), horribly.
2) People download e-book, get hooked on the story, get frustrated by the horrible translation.
3) People buy legit copy of book to find out what is actually going on.
The author may want to help with translations early in the book, but they should quickly devolve to the level of Monty Pythons Hungarian Phrasebook.
Sorry for the late post- I didn't see this story until the black-market translation was released.
Seems like if Nutella's management had any sense they would shove their current lawyers in a dark hole somewhere, and have their new lawyers sign an exclusive deal with Boloco where they would only use Nutella (sold to Boloco at a discount rate). Maybe even help them develop new varieties.
So far Nutella has only encouraged Boloco to advertise for Nutella's competitors.

Either of those excuses would probably be better received by the court than the real reason.
