RIAA should take a lesson that should have been learned in the 80's: Music videos. When MTv first hit the airwaves there was a feeling in the industry, albeit minor, that music videos would completely take over and there would be no more sales without video. And no I'm not just talking about the Buggles's song.
However, as we clearly now know, that didn't happen. In fact, music videos ENHANCED music sales. Come on RIAA figure it the f!@# out already!
stop simplifying a complicated argument and maybe, just maybe, you'll actually understand that argument enough to argue for or against it.
So i'll stress JAy's point...AGAIN. It's not a case of HOW Fairey did it, it's what he started with and how much of a transformation took place.
Even without a specialized program, such as Photoshop, I could take that photo and simply change the color and background; that would be infringement. Even if I started with a digital photo, though, I could change it enough to call it "transformed".
Ever watch interviews where a question is asked and the answer given has NOTHING to do with the question?

No. I don't. I'm a fan of music. I like music. I like listening to music. Therefore I think like somone who does THOSE things. It's high time A&R reps started to fucking thinking like that!!! That would probably solve a shit-ton of the stupid lawsuits currently in the courts!!
...but under 40 are in the age range of the information revolution. Also, 30-40 are not usually so much AFRAID of technology as unfamiliar with it, but once exposed and/or introduced to new methods they're usually all about it.
