If no NZ law was broken then no law was broken at all.
The USA is becoming more and more like Nazi Germany every day.
No wonder they are becoming the most despised country in the world instead of the most admired.
Greed has and will always bring down empires.
It has been a trait of humans as far back as recorded history to blame anyone or thing than taking responsibility.
Mental illness has existed forever but alas the last few decades have shown a reduction of the care of these sufferers which, in so many cases, lead to loss of lives.
Governments underfund health world wide. The private health providers are not interested because there is no profit in caring for the disabled.
I am not saying increased funding in mental health would eliminate all the crazed actions in this world but it would go a long way in reducing them.
Blaming the internet is simply a cop out for failure.
The one flaw in this imaginative idea is that science has shown that even if the body can live longer the brain can't.
According to some research the human, living a utopia existence, that is disease and stress free environment, may be able to expand his brain life.
Constitutions are not law.
A Constitution lays out how a country is to be managed and the boundaries in which law may exists. The same applies to any Bill Of Rights
Matters regarding the constitution are dealt with the highest court in each country. That court can only decide if an action is within the realms of the country's constitution. It cannot apply law to it's decision.
Actions against so called illegal downloaders are dealt with under law.
Breaches of the constitution is not dealt with by Law but by civil action.
If you note actions taken is the highest court are never listed as the people vs but always as an individual or group vs.
If a society disagrees with a law then an individual or group can challenge the legality of a law in the highest court but only for that court to decide if that law is constitutionally valid.
So if people here disagree with the actions of law enforcers then challenge it.
Artists whose emphases is to get a big selling records are, for most cases, doomed. The artist who refines their live performances and do it because it is what they love live on.
I spent most of my life entertaining as a singer, band member, actor and radio DJ. I never had a hit record nor did I became a household name. I did, however, earn a comfortable living, bought a house, raised a family, sent my kids to good schools and college. I have seen my fellow entertainers who traveled the fame and fortune road and of those only a handful remain in the business. The rest became disillusioned, went back to a 9 to 5 job or sunk into a mere existence. Those who just kept doing what they do regardless of fame and fortune are still performing and are generally happier.
A wise man once said, "Do what you really love and the money will come" So the "Kickstart" CD, exactly what is the objective?
Make a CD but make one you will be proud of be it a hit or not.
The sound of applause is far more satisfying to an artist than having a top 40 hit.
My friend, Barry McAskil, is now 71 and still singing and playing. His aceivements are plenty but his pride exists in an album his band, The Levi Smith Clefs, recorded in the late 70's "Empty Monkey" Do a Google and listen to the CD. It was never a big seller. It was never designed to be but has a special place on Barry's mantle.
Five minutes after the to be US War of Independence was won oppression and paranoia started. Anything that was deemed British was discouraged. Simple things to start like driving on the right side of the road, calling scones biscuits, Calling biscuits cookies, changing some measurements, currency and the list goes on.
The USA has a long history of oppression from the treatment of American natives, burning so called witches, to liquor prohibition, McArthurism, Hooverism and all done for the good of the people. So what is different now. Nothing.
The USA is not, has never been and will never be the land of the free. It remains the land of the privileged few paid for by the majority.
Well some folks are finally waking up to Apple's business model, which makes Microsoft look like a bunch of angles.
Apple has always been a "Do it our way or not at all" company.
They created a market convincing some that owning anything but an Apple device meant you were second class.
That may have worked with computers but the phone world is a different place and this time they have competition that may well be better than Apple's offerings.
What is needed in the USA is high penalties for any plaintiff that loses, and I mean big penalties, big enough to make them think twice.
Or, any item that is subject to a law suits should be subjected to a mandatory time limit to settle or the item goes into the public domain. Now that I would love to see.
There is no way a photographer can win a case of anyone using a photo of any publicly available scene. Any reasonable photographer can take a similar photo, manipulate it to match the alleged copyright one and claim legally that it is an original work.
Any photo taken inside a building may well be claimed by the building's owner as their property.
The only photos that could stand up over a "stolen" claim would be one of individual/s, inside a privately owned structure with permission of the structure's owners of of his/her own self or property.
Even photos taken inside a national park could be deemed to be owned by the owners of said park ie Governments.
Photos taken withour permission inside say Disneyland are either banned or deemed the property of Disney.
If I am in the range of a photo taken of a scene where I did not grant my permission then I could claim ownership of that photo, painting or whatever.
So photographers don't waste your time litigating because in most cases you cannot win.
Seeing as the "Law" is attempting to find Megaupload responsible for user's activities then it stands to reason the the US Government be held fully responsible for it's agencies and citizen's actions.
The Hollywood studios should also be held accountable for any employer, employee or actor under contract.
The record companies should be held responsible for the behavior of all it contracted musicians and so on.
Of course their argument would be that they have no control over their subordinates' behavior.
Now there is a question I would like to see asked in court.
Imagine if the courts ruled in favor of the plaintiff and Megaload was held responsible then the same rule should apply to all.

Julie Gillard's government is already treading a thin wire and one of her party's advantages over the opposition is the way they have been dealing with the Internet, especially arguing that optic fibre high speed is necessary and keeping a hands off approach.
All this is changing because of the never ending political interference from USA and the corporation lobbyists wich in many cases mounts to blackmail.
Well Julie if you want votes start standing up for us voters and tell all the anti everything parties to go jump. let them know that you represent a Government for the people not for private industry.
let them know if they have a beef with alleged illegal downloading deal with it through civil courts and not rely on Governments to legislate just for their favor.
I live in a rural town outside the USA. We have no theater, no video store, (it recently closed) no access to Netfix or such due to restrictive copyright laws which in this case solely exist to protect local distributors, usually subsidiaries of the major's.
So how can my downloading a movie that I have no other way of seeing, apart from traveling 100km, be considered illegal.
My challenge is if they want to play the copyright game make every movie locally available to me on the release dates.

I see this "Spying" as an opportunity for those makeup artists who are going to be out of work because of the naughty movie downloaders. Wig, costume and makeup suppliers could make a killing.
