Meanwhile, in reality, a lot of people will be in financial ruin because of the expensive lawsuits/settlement letters, or because their internet service got flagged by these leeches on society called RIAA and MPAA, for possible venues of potential infringing use, and to defend their web service against those attacks they had to pay a lot of damages or just shutter it.
Causing more bad blood against the RIAA and the MPAA, making damn sure that the market that these labels think is there, dries up even faster.

There was a person pressing a button that started the medical scans, I imagine. So that person would be the copyright owners of those images, unless the hospital decides to add a clause in that person's contract that says that the hospital is to own the copyright over those images.
So what is it, the DMCA is not strict enough or just strict enough?
You claim that people go through loopholes in the DMCA, we call you out on your lie, and you say: "No shit, Sherlock." So which is it. The DMCA is riddled with loopholes OR it is strict enough for your purposes and you don't need a SOPA law, it just needs you to get off your lazy ass.
Besides all of which, the burden of proof should be on the side of the accuser, not on the side of a third party.

Trademark laws evolve around the confusion consumers might have when buying a product. For instance if a label/name/colour(sadly) of some product closely resemble the label of another similar product. With the operative word being "SIMILAR".
How are shoes similar to candy?
Unless Footzyrolls have indicated they want to start selling candy, Tootsie roll shouldn't have a leg to stand on.

Well, the DMCA has been used to censor people's speech. Just count the number of videos with "Happy Birthday" in it that have been removed from Youtube due to a DMCA violation.
DMCA turned the whole burden of proof around. Suddenly any jackbooted RIAA-like thug could complain about a DMCA violation, and you, the original uploader, have to prove you have the right to upload that video/song/book/picture/painting.
Just to name a number of stereotypes, which are mostly false anyway, we have the lowest percentage of drug addicts compared to the US. And I HATE cheese and tulips.
