Yes, there are things mandating that they keep records HOWEVER.... those records only have IP address in them. Not things like MAC Addresses (which even those are easily faked), etc. that would DEFINITELY point to one person or another!
At first, years ago, Limewire shared your WHOLE ENTIRE HARD DRIVE! After complaints, the last 7 years or so, Limewire has only defaulted to sharing your music, pictures and downloads directory by default. Not even your My Documents directory in Windows!
So, I don't understand why people are blaming Limewire for this when they fixed the problem YEARS ago.
Many of these organizations are not challenging these things because it costs too much to challenge them, and the loss of one customer is not going to hurt them too much so they just comply with the legal requests.

Agreed. I think that is what Google should do when things like this come up: simply ban the whole country from seeing the site and when the inevitable backlash happens, point the people at the German courts, saying "Hey, we had to do this to protect ourselves, blame these idiots!"
