"WE'RE"? Who the eff is "we"? Seriously. The volume of discussion across this site, the PopeHat site, Ars Technica, Fight Copyright Trolls is pretty much validation of the interest in this topic.
Jump to Twitter and read the activity all day today on the #Prenda thread and it's confirmed.
This is the most interesting, entertaining and quite relevant cases to ever come along regarding copyright & copyright trolls, and how they go to the lengths they go to.
Living just a few miles from the court, I was tempted to go, but then figured only Cooper, Peitz & Gibbs would be there and Wright would just issue bench warrants all around for the rest. Fortunately the #Prenda tweet stream kept me sufficiently entertained and the little bit of live tweeting that was done helped round it out.
Can't wait for all the full write-ups later today/tonight!
so many ways to respond to your notion of "only an idiot"...
I don't own any other online-only games. I've been a SimCity owner previously - and never before had any in the series been online-only.
Personally, I'm not a "gamer". I don't read gamer forums. Nor do I follow gaming news or visit gaming sites. I don't buy games I've never played before without doing research. Every previous version of SimCity I've owned was thoroughly enjoyable and each new version was better than the last.
So in that respect, there's no justification for calling someone like me an idiot. I had, until this week, considered myself reasonably aware enough of the SimCity franchise.
Now however, because EA has chosen the maximalist route, and failed to properly disclose this issue in their marketing spin, I have learned.
Yes, I've learned after spending the money.
No, I'm not completely unhappy, because what I have played when I've so far, in the horrific launch cycle, has been as good as all the other previous versions in many ways.
And even if I'm forever relegated to playing this online, I'm more than confident I'll get countless hours of enjoyment out of it. Hundreds if not several hundred. So what, that works out to pennies per play.
And yes, from now on, I'll be more aware and cynical of other situations that might lead to this.
But an idiot? please. Take the thoughtless inconsiderate teenage troll attitude and shove it.
I hadn't even known the game was still in existence until recent news about it. That news had NO mention it was "online only". When I viewed the preview trailers, NO mention of online only. Pre-paid for it. First couple days trying to download then play it blew wads.
Have had a couple good sessions, though a mixed bag of continual play vs. being knocked off the server.
If the server you're on when you start a city is busy when you return, SOL baby. Start a new city. wow.
I do expect it to get better but the online only thing? for $60?
And the online petition is now up to 47,000 signers. So yeah, a sliver of hope on that concept. WTF should I, a paying customer, have to be online to play? Oh right. I must be a criminal because I own a computer. So I must be protected from being tempted to join the piracy.
So. As an Internet marketer, I can access several services that let me "auto-post" to any of my various social media accounts. Without me actually logging in or visiting or checking.
How would that affect this? Blow it out of the water.
Now - let's talk about slippery slopes.
To ensure privacy, such serving would be required to be posted as a private message to the account holder.
Since account holders shouldn't just "friend" anyone or "follow" someone back without first seeing who their public persona makes them out to be, that would require a NEW law. One that authorizes the server company (on behalf of the court, law office or sheriffs department) to gain access to your private account through a back door required to be set up by the social media companies for this very purpose.
There you go. We just now entered into the toxic slime of privacy invasion.
1. She's the CFO & Director of Business Development at Stayart Law Offices.
2. She's attempted various rookie Online Reputation efforts - hopefully without actually paying someone for those efforts. Alternately, someone looking to annoy her did that work just for kicks. I doubt that's the case because bevstayart.com bevstayart.org and bevstayart.net all register to the same IP block.
3. her own sites as well as her VisualCV profile contain content referring to her suing AdultFriendFinder for misappropriation of her name. Heck- that little tidbit is even in the meta Description that shows up in Google results for her name.
Why would it show up in Google? Because the VisualVC site has no meta Description. So Google grabbed the OPENING SENTENCE from the profile SHE (or someone who said "trust us") set up. Because I guess, that was, at some point, one of the things she was showing up for specifically. And now she's in "counter-warfare" mode.
Which is, of course, like filing more such lawsuits, just throwing fuel on the overall fire.
Really good concept to consider. I think it's a matter of both being true (with the big bang model still being mostly that extreme rarity, yet on such a large scale as to become much more in people's awareness).
And not for nothing, the geek in me was like "please don't tell me "Big Bang Disruption" means one of my favorite tv shows is going off the air"..
I recently received a CSV from a client with 750,000 rows of data in it. Couldn't open in excel because there were too many columns and too much content within some of those that the resulting combined processing power necessary was not within Excel. Maybe it would be on a super-computer. I ended up having to open it up in MS Access. So I guess the issue is whether Hansmeier or his brother the other "technician" would be intelligent enough to know how to do that.
Maybe one of them or their cronies are reading this comment thread and now they know. So if it gets that far, I'll have to send them an invoice for this consulting service.
Recently, we changed our policy regarding banned items on airplanes, to now permit certain knives, baseball bats, and hockey sticks as carry-on items. Our intent was to help speed up the check-in security process at our nation's airports.
In light of recent backlash on this change in policy, we have decided to further amend our policies to no longer permit pastries on airplanes. The potential threat they pose is far too great to permit.
While knives, bats, and hockey sticks may be wielded in a way that feels threatening, we believe anyone carrying a knife, bat or hockey stick is clearly doing so with no intent of ill-will. As such, we are moving forward with allowing these items onto planes.
case in point - California elder care facility that let a woman die because it's against policy for staff to perform emergency first aid. Even though the 911 caller was a nurse. Trained in CPR.
Even in this scenario, the California good Samaritan law protecting such acts isn't enough to stop people from basing decisions on fear of litigation. Even when someone could die as a result.
upon receiving your letter regarding today's incident at the school, I spoke with my child. When I asked if he was upset by this incident, he said burst out in tears. Clearly this mornings incident caused him unimaginable pain and anguish.
Eventually I was able to calm him and reassure him that he was safe and I would protect him. And eventually he explained to me that his pain and suffering were over the fact that your school is run by a bunch of maniacal deranged lunatics who go around violently admonishing students and causing mass panic.
The mere fact that your staff are fully grown adults and our children are tiny physically is enough for me to express outrage over how you treat them. The notion that you would bully them and punish them for their innocence is appalling.
That you left my child traumatized by your actions is unspeakable.
So yes please, schedule a session with your counselors ASAP. But instead of my child attending that session, I prefer you require your entire staff be in attendance and forced to look within their soulless hearts over this matter.
Maybe they should just skip all the individual filing and contact the interwebs directly. That way they can get every IP of every person who ever used the web. Sure would save the expense of filing fees.
I have never before read an entire full day's Deposition. Ever. I just spent how many hours reading this one. Wow. Beyond captivating.
Among all the other points brought up, I think it's extremely important to note that toward the end (somewhere around page 240ish) the recording is played that leads to the discussion of how they harass people with legal threats - going after people they didn't originally name as a defendant - using FUD against family members.
Coupled with the obvious notion that it's all a shell game designed to propagate copyright troll revenue, and how this is all just a group of about a half dozen guys all sleeping with each other and well, I hope they all get thrown in jail.
Re: Re: Judge Otis Wright is merely giving guidance
I don't see it as sad. I see this with great joy. Because this one is epic in its stupidity proportions, a feat I hadn't considered possible until it came about.
And the more stupidity, the more attention such cases inevitably bring to the underlying framework that even allows these to get this far.
As scary as it may seem, there are people who actually speak the same way Matherne communicated in writing. Cultural, regional, familial... whatever the foundational cause, and as much as we prefer to believe "that's butchered language", to some people it's their distinct way of communicating.
As an SEO specialist I've seen this insanity way too often.
It is, in almost all likelihood, an attempt to get search results for Ken Matherene cleansed of the old entry that comes up when searching for his name. It really has nothing to do with the foundation if that's the case. Pure personal brand damage "control". Bizarrely addressed in the extreme.
He has no comprehension that he's now done like everyone else who chooses the path of outrage, and just added even more such entries under his search results.
Dear Ken - congratulations. By threatening PopeHat (love how you interpret that moniker as "pot-hate"...) You've now thrown massive volumes of gasoline on your online reputation fire. And by going after TechDirt, you just brought in an entire tree's worth of additional wood for the fire.
