B. There's a difference between teabaggers and Teabaggers. I do not identify all conservatives as Teabaggers. In fact, I am rather conservative/liberatrian. Here's another thought: since this lawsuit would make it impossible for Melissa Molinaro to do any commercials without the everpresent threat of another lawsuit and would effectually bar her from doing any more advertisement work, she should just counter sue Kim Kardashian for interference with commerce. I'll bet that a threat of a 20-yr sentence would do wonders.
First of all, why did she sue Old Navy? Old Bany doesn't look like Kim Kardashian, Melissa Molinaro does. Shouldn't that latter have been sued for infringement?

Interesting... But my post was more on the use of devices not directly involved in treatments. I know that arterial stents, pacemakers, as well as surgical procedures need approval. But do the completely external devices have to be approved as well?

Unless I am woefully misinformed, I'm not sure why FDA not controling the medical devices would be a problem? Since the devices themselves aren't for curing any illnesses, then the FDA can be completely bypassed. Do the folks at FDA have to approve the heart-rate monitors? The MRI machines? I know NASA physicians have been exploring and testing biofeedback devices in their regimens and training. So why would the "tricorder" even have to be approved by the FDA? As long as the FCC signs off on the device as not producing harmful emissions, they should be good to go.
It's bad enough that we have the copyright vs free speach issue but now we tack on the legitimate perposes vs free speach? And who is going to decide on that with what standard?
