They do need a warrant for surveillance (24/7 only. short stints not so much but they better be ready to show reasonable suspicion you were gonna do what they thought you were gonna do)
Your case:
Talking in public you can not expect privacy when you have others around you.
GPS tracking of your car is different..
Other case: You are talking and some guy in a black suit glues a megaphone to your mouth.
now to take it a little further...
you have this megaphone attached to your mouth and you have no idea until you go to take a sip of that coffee you bought. Oh those delicate flavors of caffine and coffee...oh crap, lets take this megaphone off so you can drink it...BAM! Obstruction of justice.
I don't know of this happening yet, but I bet it will happen. Some poor person removes it not knowing what it is or who put it there or why, but hours later these men in black come knocking on the door asking for their equipment back and telling you that, despite them not having a reason to do so, you are now being charged with obstruction of them not finding anything to charge you with...
Honestly, I somewhat agree, it isn't a win for file sharers, however I don't think that is what Mike is saying though I can see how someone who already dislikes Mike can see it that way.
The agreement between the lawyers and the copywrite enforcers went above and beyond what a normal charge for a case would go. Their entire model and methodology is to get as much money without ever seeing light in a court. They not only got a percentage of winnings, but got MORE if the case never went to court, though I am unable to point to articles here from work, but honestly, I can't blame you for not trusting in the word of a blog commentor.
If tempo made the difference between copyrights then there is a big issue. Every song made over the last 2 decades or more (I am being kind) was derived from Blues rifts. They usually play in a different key and/or tempo but the rift is the same. This means every rock song EVER was STOLEN and RIAA owes BAJILLIONS to the dead bluse bands...then again, bluse was created off other musical types. So in reality, assuming this claim is reality, everyone owes 9999999999999999999999999999999999999999999999999.91 gabjillion dollars to the person who first hit a rock with a stick.
More like Righthaven is acting like a TV bad guy, telling the plot of how their way is far superior than the one the Judge came up with so that is the one they should all go with.
I was actually thinking it should now give those who paid the right to sue both righthaven and the media people for false representation. IE Fraudulent claims. Righthaven claimed to own the copyright, when they didn't, threatening people with lawsuits that they had no right to threaten with causing people to pay them money. I would say, 35k/case? Maybe 50k for punishment?
not to say anything about your idea of what would happen...
If the big labels suddenly stopped playing in the sandbox, do you really think Google? MS? the computer industry, would notice?
Alternately, if Google, MS, and the computer industry packed up and went home, the Music industry would be back to pen and paper, and it would cost them even more to promote their music cause most forums for concerts, radio, magazines, use computers now a days and they would be less likely to work with big labels..
I moved. My doctor has all my records in digital format in a holding house that, when I need a doctor to see them, charges me a mere $150 so any new doctor can see them but CAN'T PRINT THEM OUT. They get a one time viewing license. WTF!

There was a part that he stated that "We were unable to sell the images because they were openly available on perfect 10's systems..." he then later corrected himself and said google...but I got a good chuckle out of that.
I agree, though just because its not in the article doesn't mean she didn't disclose such information. I would like to see the case itself or the blog.
