Another funny thing about this whole DMCA exemption process is that those who want to "pirate games and get out of paying for them" aren't waiting for permission from the government to do that. They have been doing it for years.
What this will allow is not only for those who want to "rip a ps1 (or another system) game you already own onto a psp or other portable system". They also want to be able to import games from other regions, play homebrew games, use homebrew software, etc. All these legal uses would be more widely available to law abiding citizens.
To continue in the belief that making an exception for console jailbreaking will result in more piracy is a fallacy perpetuated by console manufacturers. Rather this will open up the console to more games and competition.
I usually don't correct those who use "theft" or any of its variations more than once in a conversation. When I do it is at the beginning and from then on I simply use the term "copyright infringement". It is pointless to keep correcting them unless I feel that they are completely missing my point because they are equating it with stealing.
If this were a Youtube video that would work. Sadly, for some reason Viacom won't put any of its videos on YouTube. I can't quite figure out why though.
No. Those developers are making excuses for their shortcomings. Ubisoft are the worst when it comes to making decisions that negatively effect paying customers. That is why they don't make money on PC. Hundreds of other developers do just fine on the pC in spite of the piracy.
I vote with my wallet every day. It doesn't matter what excuse bad developers use to continue bad business practices. The point is to reward businesses whose practices you agree with and whose games you like.
If those developers who are losing sales because of DRM can't see that these other DRM-free developers are making loads of money, that is not skin off my nose. They are idiots.
Considering there are more game developers, more avenues of distribution and more development tools for indie developers now than there were 10 years ago, I don't think piracy is scaring off anyone.
So how is the games industry hurting? Its not. It is doing fine.
I think the buggy whip analogy is apt. It exemplifies exactly what is happening here.
What is it that people want from buggy whip manufacturers and their associated industries (eg cart manufacturers and horse breeders)? They want a more efficient mode of transportation.
Now here comes Ford with his new automobile. This new invention provides that service people want, transportation, is a more efficient package. It goes faster, has lower maintenance costs and is affordable. People love it.
This shift from one form of transportation to another is part of a thriving market and economy.
Now back to the content industries. People want the content. This is what is analogous to the transportation. In this scenario, the content is being offered on one format (eg cd and dvd). Along comes this new format (digital distribution) and suddenly the market shift goes from cds and dvds to digital files. So what happens? The buggy whip manufacturers (labels and studios) are trying to outlaw cars (digital files and distribution).
Trying to fight market shifts is futile as any historian will tell you. The only thing for legacy industries to do is adapt.

As for the contents of the box set, I have corrected the article based off of Amazon's product listing which states there is only 1 CD not 3. I think NBC New York misinterpreted that.

This is a report that shows that music piracy is down in the UK. It does not show that piracy is "under control" though.
