Matthew Inman To Charles Carreon: Take Time Off, Stop Saying Crazy Sh*t To Journalists, Calm Down

Now that the details have come out about Charles Carreon's lawsuit against Matthew Inman, IndieGoGo and the two charities Inman is raising money for (and the details are as nonsensical as we expected), Matthew Inman has written an open letter to Carreon, suggesting that he might want to calm down a bit. He points out that, contrary to Carreon's claims, he did not "incite security attacks" on Carreon. In fact, Inman not only focused his anger at Funnyjunk, but also went further than necessary to keep Carreon mostly out of it:
So when did this transform from Oatmeal VS FunnyJunk to Carreon VS the internet? I'm going to take a wild shot in the dark here and guess that it's when you announced to a journalist at MSNBC that you were trying to shut down a charity fundraiser which would benefit cancer victims and endangered wildlife. THAT was the moment when the tide of public opinion focused on you instead of FunnyJunk. I never encouraged anyone to attack, harass, or otherwise contact you. In fact in my original letter I blurred out your contact information and I linked to your Wikipedia page instead of your website. If I've directed energy anywhere it's been to the fundraiser page.
He also tells people not to harass Carreon. He goes on to point out, accurately, that this whole thing has probably been humiliating and points out that the lawsuit is quite likely going to get dismissed, but also offers Carreon a possible path to backing out of this mess:
Your lawsuit is meritless and it'll probably just get dismissed, but I'm guessing you're just going to keep trying until you find an angle that sticks with a judge. My advice: take a few weeks off, stop saying crazy shit to journalists, and come back when you've calmed down. Write an apology to whomever you feel is appropriate, or just don't write anything ever again.

Maybe start your own charity fundraiser as way of apology. I'd donate.
Also known as "the stop digging" solution. The same one half the internet has been suggesting for the past week. The same suggestion that Carreon keeps ignoring -- leading at least some people to start calling the impulse to keep digging the Carreon Effect. That moniker will likely disappear if he does, in fact, stop digging. But what are the odds of that happening?

    Hell hath no fury like a lawyer scorned

    One the one hand we have someone realising that despite the weapon of copyright being available to them, a less antisocial and more conciliatory approach to those who show no respect for authorship is more appropriate in these times (in which the 18th century privilege is dissolving).

    On the other hand we have someone with contempt for culture and those who create it, showing no hesitation to exploit both it and the law as a weapon against anyone they feel impugns their patently mercenary and unscrupulous character.

    This is not about copyright, but about mankind's cultural liberty, moral rights, neighbourliness, and the abuse of law (by lawyers as well as legislators).

    Seriously this is a guy who probably has had a lot of power over people for a long time and he can see not only that the power he has disappeared overnight and turned into laughter about himself that the only way he sees out of this is to find some way to try to justify his actions. Even if he gets to sue for some totally random point that results in a warning he will claim he has won.

    This is the sign of a desperate man , one who will probably have a nervous breakdown when he cannot get his way, you know the type , the person that daddy gives everything to and is never told no. Sad as this is going to be a very hard lesson for him to learn.

    And people showing him pity is just going to anger him more and more, i think a doctor is needed in this case not a Judge.

    Well, if he were to do these things Inman's suggesting and also take up the opportunity to make an apology, he's going to be spending plenty of time writing to the whole Internet for his stupidity... but then again, why should he apologize? He provided some good entertainment and he has become another symbol in the Hall of Internet Stupidity, and we could use that to show future lawyers what would happen if you mess with something we use on a daily basis!

    Just curious...

    The demand letter Carreon sent was supposedly representing his client, Funnyjunk. Yet in the MSNBC interview Carreon said 'my mother' when referring to the picture Inman had drawn. Several references he made to Inman's response letter seemed to indicate he thought it was directed at him personally. Seems to me a lawyer would know better. And now bringing the lawsuit himself instead of for Funnyjunk.

    Has anyone heard anything from the owner of Funnyjunk since this fiasco began? Even a no comment?

    This is about copyright.
    The defamation by Inman attacking a host of "users that share images", claiming that funnyjunk stole, altered with intent to deceive and then profited from Inman's work.
    But.....It has been manipulated into something else.
    Question is ... who has been doing all the manipulation ?

    Inman has done no manipulating. He ripped on a rather shameful letter, which demanded $20,000. That same letter is the one that got people upset at Funnyjunk/Carreon. Not anything done by Inman. Then, to make matters worse, Carreon then started making wild accusations (like you are doing), followed up by his wife doing the same, and then decided to sue two charity organizations (for the sole reason being that apparently Inman picked them at almost random to receive any donations sent to him regarding the $20,000 demand amount).

    The one who should have quite obviously fucked off from the get go is Charles Carreon. In this day and age to think sending a letter demanding money won't get laughed at and posted on the internet for the world to see is stupidity at it's finest. He made a rather huge and quite public mistake and rather than say, "My bad, let's just let bygones be bygones and all forget about this thing," he decided to keep on keeping on. Which in his case means foaming at the mouth and making legal threats and what can easily be seen as defamatory statements about Inman (lest you forget the readily viewable statement claiming that Inman was behind the attacks on his website).

    Sorry AC, but you're taking the side of someone who has very much been in the wrong this entire time. And much like that same person, you're making wild statements without any proof whatsoever to back them up. And... comments on a blog are quite meaningless, lest we forget the comments on Techdirt (some of which are quite ridiculous at times, posted by ACs just like you).

    My open letter to Carreon

    Dear Chuck:

    If you're going to C&D a blogger or outspoken online presence, write it for public publication. Period. And advise your clients why -- and how it may affect them.

    When you assume your letter will be published, it forces you to think about presentation, tone, and gods forbid, the merits of your position. It's one of those nasty side-effects of the Internet Age, but hey, adapt or ... well you've seen what happens otherwise.

    See, as an attorney, your job is to resolve problems; lawsuits are what you do only when the problems can't otherwise be resolved. And when you keep that in mind, along with the very real chance your efforts will go public, you'll find maybe it's not a great idea to send a C&D asking for $20k for protected (even if obnoxious) speech, for claims based on a year-old blog post that is no longer accurate, for a client who itself doesn't have the greatest online rep. And then you advise your client accordingly.

    Oh, and remember, the true, existential purpose of lawyers is to act as a buffer between two parties who can't talk reasonably. It is not to insert yourself personally into the fray.

    I'd bet that the person who made the "not your personal army" comment meant that comment for the people calling for attacks on Carreon.

    Inman may have acted out of anger and spite, but everyone does that at some point in their lives. He intended only to mock Carreon and Funnyjunk (as well as raise some money for charity), and Carreon has turned it into a legal brouhaha Inman obviously doesn't want to deal with.

    Inman did try to provoke a certain emotional response out of his readers, but that doesn't mean he intended to turn his readership into a "personal army" dedicated to attacking Carreon.

    Carreon has done such a great job of creating a "personal army" out of Oatmeal supporters by acting like an ass that he doesn't need Inman to say "go attack Carreon".

    Not to derail your thread, and I do hope that somebody else can answer your question, but you bring up a good point that hasn't really gotten much attention:

    Carreon has basically gone legal-postal over a 'yo-mama' joke. It seems like Inman has struck a real nerve here. We may all be guilty of being very insensitive: what if Carreon's mom really was molested by a bear?!? What if *he* was? That would almost certainly leave some powerful psychological scarring! Not to mention the almost inevitable physical scarring.

    Tickets are available, but there is few things to remember.

    Using people for your own gain is a requirement, not an option.
    You have to learn to choose the people you use wisely, you have to live with yourself after all.
    Your skills should never be manipulated out of you, research the people who say, "they are worth giving a fuck about" and want your help. You could unknowingly be helping a real sick-fuck, again...you have to live with yourself
    Be no ones personal army.
    You should never use an innocent party.(including charities)

    Manipulated public opinion and media coverage, using charity and his skills as SEO, viral marketer and link generating scam artist to spam his message.

    I don't buy the narrative of....

    The law MIGHT say he did do something wrong.

    Finally, I am sure he is really a nice guy, but calling filesharers "thieves" for sharing his comics is a blatant lie.
    USING a charity for personal gain (PR) is really slimey, that is what pissed me off the most about him. He didn't have to do it, and there is no indication that he acknowledges that it was a slimeball thing to do.

    Raising money for charity is good, but doing it as a way to fight a defamation case, doesn't even make sense.
    HIS positive public perception OR funnyjunks negative public perception... is the reason he raised money for charity.
    He used the charity for his own personal gain... in this instance.

    I am not the type of person who takes people at face value so even if, in this instance, Inman is being a using bastard, that does NOT define him as a person.

    People are accumulations of good and bad.
    I am not the one with a one sided view on how Inman is 100% good or bad. I find that one sided view to be ridiculous and naive.

    It doesn't matter what you think of Inman. Looking through the comments everywhere I would actually say the audience is pretty divided on that subject with half of them loving him and the other half hating him (and the rest of us in the middle), but it doesn't matter because that really has nothing to do with the issue.

    What matters is that Carreon is abusing the law. That has the potential to effect all of us and is a very serious issue. This situation has presented an unexpected opportunity for people to speak up about their concerns and they are doing so with gusto.

    As a lawyer, Carreon has an extensive education and had the opportunity to respond to Inman in a rational manner by writing a well considered and intelligent reply and riposte. Even if that meant recognizing his initial errors it would have gotten him much further then then this fiasco will. Even if he actually wins something in court (unlikely as that is) he will still lose since this will pretty much destroy his credentials.

    Your attitude toward Inman has nothing to do with this. Other then his position as fire starter and defendant he also has no real part in this. This whole Abuse-of-the-Law thing is Carreon's work. Thus he gets all the attention, good or bad.

    In fact I would even say that at the moment you are guilty of attempting exactly the same thing you are so upset about Inman doing: manipulating public opinion for your own purposes. (Of course that is what trolls do, so perhaps congratulations are actually in order here.)
