    The one fix that I'd like to see is having copyright trump patents.

    Basically if you can copyright it you can't also patent it. This would kill both software and business model patents.

      I'm not sure I understand what you mean here. Copyrights and patents cover completely different things. There's not a lot of overlap there.

        I think he means software patents and business process patents.

        Neither of these concepts even deserve a patent yet they exist!

        It seems to me that he is saying that copyright and patent should be explicitly mutually exclusive, and he is right. And while you are right that copyright and patents cover completely different things, they are not be used correctly! or even according to the constitution.
