Techdirt Podcast Episode 96: Death Knell For Software Patents

from the the-bell-tolls dept

Software patents have been dubious since their inception — not just in principle, but legally too. Past rulings have called their validity into serious question, and now an opinion from a prominent pro-patent judge has called for people to admit that they simply shouldn't exist. This week, we discuss what this opinion means for the (hopefully short) future of software patents.

Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.

Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.

While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

This week, we discuss what this opinion means...

What it means is waves of hyperbole from patent trolls and their owned and operated congressmen in the near future.

"First they came for the One-click patent I did not speak out, because I did not license the One-click patent...."

The Author is Living in his Own World

The author must be kidding! He’s living in his own world. Inventions that have computer software in the Specifications section of a patent application are alive and well. And Judge Mayer is simply misinformed. To understand why the author is flat out wrong when the author fantasies “death knell for software patents” see my Oct 2016 article "50 Years of Controversy Rages On: A Closer Look at Computer-Implemented Inventions" in IPWatchdog.
