This time I agree with the author of the article. I have said it over and over that I would gladly pay a reasonable monthly fee to be able to download, listen to, and watch whatever I find on the Internet. I don't want to sell the content or even give away copies of it and a lot of the time I don't even keep a copy after examining it.
If the content was available legally for people then we wouldn't give the guys at the MPAA and the RIAA a job.
They would be out of business and would simply cease to matter.
What this tells me is that many people would rather receive their NEWS, MUSIC and VIDEO on the internet. It makes it easy to do and instead of fighting and alienating an entire market why don't they come up with a payment plan for the consumer. It has to be a reasonable fee because every penny is profit for them on the Internet. They don't have to have any media for the product. It's seems like a great way to market a product. It reminds me of Insurance, Money for Nothing.

If Unger drew the design before making the Firebowls and included the drawings in the copyright application. Do you you still believe the same thing? We have artists working for us and we always copyright their artwork / designs when produced. How is a Song different than Artwork?

Frankly I can't believe that you wrote that it was OK to copy / steal Artwork from someone else. I sure hope you copy / steal something of mine because I would sue you from one end of your hell to the other side.
Unger's problem is he didn't sue. That is a blatant ripoff and we need to have the courts decide these matters rather than some freak writer who thinks it's OK to share Artist's Artwork.
Who owns the original patent for making Firebowls? Did you take the time to search the patent office. Both of these guys are possibly breaking 6 patents.
Why did I check the Patent office? Hardware (bowls etc.) is a device that is patentable.
Artwork / Designs that are applied to the surface of an item are copyrightable which is what Wittrig copied from Unger.
But both of them copied the firebowl which is patented as a cooking device in 6 different patents. So next time you write an article please put on your thinking hat and do the proper research.

Like I have stated many times: If my ISP would bill me a fair amount each month and then I would be allowed to download what I want. Everybody gets their vig then and even the ISP can make a cut. No matter what road they travel I am going to use the Technology they made available to me to it's fullest. I don't look at it as breaking a law. I bought Internet Service and while using that service I found Web Sites that allowed me to download files. What's the problem???
The only problem I see is the inability of entertainment companies to make money where the market is. This is a great deal for them. I do all the work, I download a file and then burn it to a blank if I want to use it away from my computer. If I want to listen to a cd or watch a downloaded movie I even provide the media. I don't see how it costs them a dime. I paid for it with Internet and Media costs.
Also I will state that I am old and disabled with very limited income. If I didn't download it I would simply wait until the product was available on Television or Radio. In other words I wouldn't have bought it because $20.00 is a weeks worth of food and contrary to popular belief most of us would rather eat.
My ISP advertises on TV and Radio and Internet about their blazing download speeds. That is the crux of their marketing and I bought it. They told me I could download Music and Videos much faster and that's what I paid for.
Who's the bad guy here?? I don't see one. I'm just consuming what I paid for. If they want more money then they need to negotiate and charge for it.
I see lot's of missed opportunities for the entertainment industry. Instead I see a public relations nightmare for the entertainment companies. Who can support an industry that make hundreds of billions of dollars and sues a person over a $20.00 product. This does not promote any kind of loyalty or even the desire to buy their product.

There is no invoice and no list sent to any of the collection agencies (ASCAP, BMI, SESAC) that tells them what the money is for. The agencies listed before just collect a flat fee with no bookkeeping required. Talk about obsolete business models.
TechDirt should do a real expose on the abuses in this industry.

When is someone going to step up and manage this business correctly. There are so many little domains here that it is impossible to make anything happen.

We are programmers here and it would be very simple to place a value on movies and music that won't break the bank and then let the ISP collect the money with their regular monthly fees and that's the end of the bullshit. How many indie bands and movies get played or downloaded without any payment to the creators? Then everyone's work would be able to be charged for. I go to the movies and pay the exorbitant fees. I buy records that I like and have heard the whole thing. If it's only one song that's good then I listen to the radio.
Most new release movies available for download are inferior in quality. So if you want to watch it free while it's in the theaters then you watch blurry movies with sound that echos. How does a movie company lose on that? Many people can't afford to pay for the theater. I went to see District 9 and it was 9 bucks just to get in. I had to sneak in the snacks because they sucked up my cash just paying for the seat. So they screw themselves.
I spent years writing software for money and it's easy to sit and dream of the money you lost because of illegal downloads. But the truth is: Unless you have an exceptional product that everyone wants. Most people uninstall as much as they install. I only lost if someone got value from it and didn't pay me.
Under the current copyright laws everyone breaks the law. If you hum a tune you are performing it. If you sing songs around a campfire you are performing them. If you sing a song at Karaoke and didn't pay royalties, you are breaking the law!!!!
If you make a copy of anything you break the law, when it used to be you were allowed to make an archival copy in case your original broke. But now companies even try to stop you from doing that with copy protection schemes.
When will our governments start protecting the people by passing laws against these predators (Record and Movie companies in particular, with software bullies thrown in) and protect the people of this world from them?
