Just distribute while collecting a reasonable fee and hold the money in trust and charge a moderate fee for the management of the trust. The Canadian record industry does this and hold billions in trust because it is to much effort to attempt to track down all the parties that are due any monies.

Getting back to the ruling it does make Sense to me. The ISPs are just the carries of material. Does the post office have to pay a copyright fee if it delivers copyright material? Would a phone company have to pay a fee if in the back ground of your phone call a copyrighted music played? Overall a good wording by the judge to refer to the ISPs as effectively "content neutral."
That is it... they need to tax all popcorn sales in Canada. A 'popcorn levy' applied to each kernel of sale with the money generated kept in trust and divide amongst richest Canadian artist and popcorn sellers after 5 years.
I think Google has started to clean up and patch security holes. I suspect Google sufficient confident to step back into a market where the government will do all that it can to steal their Google's knowledge and pass it to its own Government Owned endeavors (and search engines).

It is easier to just approve everything and then let the court system determine the validatility. In the seemingly infinite information age no one group can actually determine all prior art for a patent - it is just to hard so it must be left up to the courts in the case of any challenge.

With all the directed advertising experience of Google on the internet I can hardly wait till the day that Google offers a internet based TV subscription for free or nearly free. Subsidized by the ads that can be very specific to the users and the advertisers can get direct feed back to how many views and the demographics of the viewers who watch it. It is virtually a pot of gold full of view information.
I only mention Google here is because they often see the huge potential revenue to be gain from directed data mining and collection for the purpose of directed advertising. Plus they seem to have the capital to get such a massive indevour up and running.
After all you tune into your favorite program just to watch the ads. For it it was not for the ads you would not have your favorite program. It is not only the commerical break ads but the paid product placement within your program that all help pay for it all.
