Re: Re: Re: Boiled down: a "public performance" is any on a PUBLIC DVD player.
From all the crying by the content industry about the TRILLIONS of dollars lost, it appears the law loses since NO ONE EVER will pay the amount of money claimed to have been lost.
Game, set, match! Back under the bridge until sundown troll!
The thought police are on it boys, open fire on them thar pirates and freetards who be paying for what was once a legitimate service and business model. We be changing the rules mid-sail and you'll be sleeping with the fishes because we don't quite fancy the cut of your jib swabby!
This makes me want to go out and buy a giant industrial spool of cable to put between my DVD player and TV just out of spite for the ignorance on display that is supposed to be the justice system in this country.
Agreed, he is using the video to try to win an elected position that will pay him above the board quite nicely and the backroom deals which pay considerably more.
This one is barely gray in my eyes, pay up Pawlenty, or quit using it.
Better yet, get some of your congressional buddies together and let's change the copyright laws to a "beyond reasonable" time frame of 20 years and be done with this nonsense!
Are NASA pictures automatically put into the Public Domain?
If so, how does this mechanism work because IIRC other artists were having issues trying to do this (put their works in the PD) themselves in any manner whatsoever.
Selling PD images is perfectly legal and therefore not subject to ICE seizures.
And to think it took me 20 seconds to find out who you are - I wish you'd just sign in with your own name instead of trying to hide in the AC (that's Anonymous Coward - just to save you the time!) blanket.
But the law is the law! The judge said so and Goggle did so!
Everything was removed as directed, Belgium newspapers now exist on the only landlocked island known to man! They've accomplished the impossible, congratulations! By the way, isolation is a cold lonely place, but it was only brought to you at your request (ahem lawsuit).
On a side note that is oh so obviously related: How come when the law is in favor of content industries all we hear is "The law is the law!"? Regardless of how short sighted it may be, and despite how it is typically very one-sided in favor of content industries, or how a single song costs thousands of dollars in fines if you get it from the wrong site but is only 99 cents from the "correct" site, etc. The claim is repeatedly made ad nauseum as if you expect to hypnotize the world with your droning until everyone agrees with the content industries version of a one way legal system.
Here's some breaking news for you - content that is unknown is destined to stay that way and unlikely to EVER make a profit. The internet dwarfs previous all previous communication tools and if the content industry thinks they will change it to suit their needs specifically then they will suffer the consequences as these Belgian newspapers are doing now.
Apparently we're right back to my original request of the original quote:
"Lady Gaga IS a commercial interest that had or intended to make money from that video."
Citation requested.
So, your point isn't that she'll make money by directly selling the video itself? That is how I read the above quote, and therefore requested some sort of citation that would suggest any selling of the video.
Now, you have obviously passed TechDirt Algebra 101 with your clear demonstration and understanding of CwF+RtB. You even implemented the "freetard variable" by claiming the video will be used for marketing and promotional purposes. By the way, what happened to the plans to sell the video, from the original quote? You know, the whole origin of my "citation request"?
"Everything Gaga does is with the intention of promoting her brand and thus making money."
That's a Grand Canyon size leap you take from promoting her brand to "thus" making money. Your "thus" probably involves quite a bit of rehearsal time, touring dates, practice, a legal team, a marketing team, a record label and who knows what else? Hmmm, so just promoting will cause money to rain from the sky? Excuse me while I quit my job to become a wealthy marketing executive - brb.
OK! My boss wasn't too happy that I quit in the middle of the project but he seems happy for me personally since I will be financially wealthy shortly!
Damn it feels good to watch someone get dizzy from circular logic! Again, I simply asked for a citation that Lady Gaga intended to make money from that video which is what the original poster clearly stated/presented as a fact.
At this point, it appears she only shared the video and never charged anyone anything for viewing it.
You can view my encrypted packets all you want, they are being transmitted publicly with encryption which in and of itself suggests a level of privacy.
Now if you un-encrypt my message then I have an issue with your actions.
See, we CAN have it both ways!
But, if you're myopic, you simply won't understand!
"She doesn't own the copyright to the show, freetardo. Duh."
I never said she did - HOWEVER YOU made the claim she had or intended to make money from that video. I asked for proof of your assumption, chump monkey.
"Nice to see you L00nbats threatening violence. Seems to have become common here and on torrentfreak. What impossible losers you people are."
You are the one who actually brought the whole death and sword play to the table: ""2) Live by the sword, die by the sword." Also, I didn't threaten anyone, I just said it would make me happy, like watching lawyers staked to an anthill covered in syrup.
It's a crazy little world you live in, tell your Mom I said "hi" when you get to the dinner table!
"Value is not created by having someone repeat it over and over again, if anything it is likely to get us incredibly bored of it, and thus making it less valuable to us."
Actually, as Nina so poignantly explained, the quoting of a cultural item, as in the example, gives the work more cultural value. Each individual component of culture may not have this same effect on you personally, but society as a whole now has more shared culture. Many of us believe this is a good thing and this leads us to align ourselves against those who wish to limit our exposure to said culture whether it be through monopolistic practices, unreasonable copyright lengths, over restrictive patent practices or even (gasp!)unreasonably priced content some of which is actually stolen from the public domain then restricted and re-sold.
Cultural value doesn't necessarily have to have a monetary value and it could be well argued that culture is priceless, but I'll leave that for another day.
Yep - caught me off guard for sure. My sarc meter must need adjusting! Oh who cares it's late on a Friday, libations for everyone! \_/...\_/...\_/...|_|...|_|...|_|...
It isn't like they stole music and we have a clear recored of their IP address to clearly identify them as criminals.
Of course not! They actually STOLE MONEY!! That is already clearly illegal just about everywhere in the civilized world. Now once the court finds them guilty they will get their day in court that they are always blathering on about!!
"How many people that should be affected will be affected? Probably not enough."
One person would be FAR MORE than enough. This bill is ridiculous in its nature compared to how the internet works and is another shining example of how the entitled content industry believes that they are the gatekeepers to culture in our world today. Long before the internet existed, world travelers took their culture, in the form of goods, with them and shared or traded them around the globe for things they did not have access to. The internet allows this to happen from the comfort of your own home. Those who feel the need to control the normal behavior of human beings need to be stopped by whatever means possible.
