Recent congressionally passed law may have explicitly given this authority to the President. HR5122 also known as the John Warner Defense Authorization Act was signed by the president on Oct 17, 2006 John Warner National Defense Authorization Act for Fiscal Year 2007. Section 1076 Text of Hr5122 is titled "Use of the Armed Forces in major public emergencies". Removing the legalese from the text, and combining multiple sentences, it provides that: The President may employ the armed forces to restore public order in any State of the United States the President determines hinders the execution of laws that deprive people of a right, privilege, immunity, or protection named in the Constitution and secured by law or opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws. The actual text is on page 322-323 of the legislation.
I only have a small question for you Mike, does IVY League neccassarly mean "best & brightest". I know a lot of people in academia are in there for research purposes to through many many many universities. I think its narrow sighted to use the correlation of IVY for the purpose of causation to worse & dumbest" Its intellectually dishonest.
Each country has a right to determine its own laws for what is permissible and what is not. American jurisdiction includes American ISPs, American registrars, and American citizens.
What other countries do with their own jurisdictions is up to them.
Need I respond? Arguing for the sake of ACTA. Gigity.

Redefining fingerprinting technology to the point they know what fair use is: may prevent that very fingerprinting to shut the site down for the football jersey I wore in my facebook pictures. Wooops, lets hear it for Darwinism of tech!
Even the courts have issues determining what is and is not fair use. Want to see locking any content to stop, wait, determine, ad nausem to any technology? I've yet to see very many injunctions preventing any tech not to develop, let alone distribute it service.
Yes, and lets see how arbitrary the cause is shall we? and see how many request we can send in to keep this site locked up for? Lets see how far we can interrupt a business.
Rather than say.. oh going to said site and providing a warrant to release evidence.
It's not out of date, the average user doesn't even know what content ID is. Its like saying you infringed so were not hosting because apparently... Trust the Machination of Audible Magic know what fair use is! /sarc
Proof? where?
Willfully? Yes.. please tell me they can track everything!
I still remember when they allowed to the press to take pictures/video of wreckage of planes.. but somehow around September' 01 that suddenly changed. And forget about interviewing the wreckage workers!
That's called a feature of a tool something a company does to drive customers too it.
A site is not responsible for the users actions. Let alone personal use verses commercial. Do you really want an army of lawyers sitting viewing the 36hours of content uploaded to youtube every minute? Let alone sharing sites?
Easy to do the 90% of content you see is uploaded by "users" not the "site". Can you justify going after a tool? As for the other 10%, let's hear it for embracing a new technology!
