ICE Propaganda Film Pats Itself On The Back For Censoring The Web; Promises Much More To Come

Homeland Security's ICE (Immigration & Customs Enforcement) group has put out a slickly produced video patting itself on the back for all of its work censoring the web in 2011, and promising much more of that kind of thing in the future: It stars ICE Director John Morton, reprising his usual ridiculous refrain in which he conflates actual counterfeit goods with copyright infringement. But this time, he shows off his ability to stroll quickly through a warehouse while doing a walk-and-talk. I have to admit that it feels like a parody video most of the time. He kicks it off with a claim that he's explaining how to "steal an American job." Then he claims, "here's how to save an American job: IPR enforcement!"

He's wrong. First of all, the "job loss" from counterfeits is totally and completely exaggerated. As has been shown by multiple studies, most people buying counterfeits (hell, and downloading infringing works) wouldn't have bought the real thing instead. They know they're buying a fake good. So no "job" is lost there. And, as the government's own GAO noted last year, the idea that this all leads to lost jobs simply isn't supported by the data.

Second, enforcement does not "save jobs." It does put massive burdens on legitimate sites. Something Morton should know about since he's been taking down legitimate American sites with no legal basis for quite some time.

But before we get to that, he shows off some counterfeit products. There's a handbag, some fake drugs (they always have to show the fake drugs, despite it being a tiny issue, but they have to show some sort of "danger"). And then there's a video game mod chip. He says it "allows you to hack into video games and steal the game for free. That's illegal. That's IP theft." Of course, it's debatable if mod-chips are really illegal. They have substantial non-infringing purposes other than "hacking into video games to steal them for free" (do people steal stuff not for free?). But, you know, that's ICE under John Morton: declaring it illegal for you to modify products you legally purchased, like your gaming console. Thanks, US government!

Then we get to website censorship. And boy is he proud of that. You can see him gleaming as he says that ICE has "done a phenomenal job" and "every time they make a bust, every time they make an arrest, an American job is saved."

So, I wonder, can John Morton explain whose job was saved when his staffers incorrectly seized and censored Dajaz1.com for over a year? I'm curious. Because it sure seems like he actually hurt the ability of the Americans who run that site to make money. I'm curious whose job was saved when his staff deported a missing teen to Colombia (where she was not from). Is that the kind of "phenomenal" work under John Morton we should expect more of?

He then shows off "the news coverage" that ICE has gotten for seizing websites. Notice that he leaves out the stories about the mistaken seizure of multiple websites beyond Dajaz1. Like the seizure of 84,000 legitimate sites that were replaced with a statement claiming that they were all involved in child porn. Somehow those clips just didn't make the cut. Phenomenal work "saving American jobs!"

Morton goes on to talk up how "proud of the results" he is over the seizing of websites. Once again, no mention of the ones he seized by mistake, causing tremendous harm to those who he falsely declared as criminals. What's amazing is that he's never issued an apology over those false seizures. Instead, he's "proud of the phenomenal job" his team has done? What a joke.

Finally, he highlights the PSA that ICE put on the websites they forfeited. What he leaves out, of course, is that the PSA was both created by and owned by NBC Universal -- something ICE has never publicly admitted, but which we found out via FOIA requests. It's still shocking that a government agency would be using misleading propaganda from a private company and pretending that it's an official government production. Even worse, despite numerous requests, ICE has failed to show any proof that it properly licensed the video from NBC Universal, leading us to wonder if they "pirated" it.

ICE under John Morton has become a massive joke and a disgrace to American ideals of innocent until proven guilty and important things like free speech and due process. Rather than making this joke of a video (which certainly has Hollywood-style production... I wonder how that happened...), Morton should be issuing apologies for the mistakes that were made under his watch, and tendering his resignation. Instead, he's celebrating? Sickening.

NinjaVideo Admin Phara Gets 22 Months In Jail, 500 Hours Of Community Service & Has To Pay MPAA $210k

Today was the sentencing for Hana "Phara" Beshara, the admin for NinjaVideo who has received plenty of attention in the last few months. Just a few hours ago, she was sentenced to 22 months in prison, another two years probation after that, 500 hours of community service and she has to pay back the $209,896.95 that she supposedly made from NinjaVideo to the MPAA. I'm sure they'll be passing that along to moviemakers, right? Either way, what's telling here is that the judge appears to have given Beshara significantly less than what the government asked for.

After receiving what appears to be some pretty bad legal advice, Beshara was indicted, and quickly realized that she was left with little choice but to plead guilty in the case. Just a few weeks ago, we wrote about the fantastic and detailed American Prospect article by Rob Fischer, which detailed Beshara's story in a way where she certainly made it clear that she didn't agree with the reasonableness of the charges against her. Once again, it seems as if Beshara has been on the receiving end of bad legal advice (talking to the press post-guilty plea, but pre-sentencing... not so smart).

The US Attorney, Neil MacBride (who, it's important to note, spent years as the Business Software Alliance's "anti-piracy" boss), asked the judge to throw the book at her, using Fischer's article to repeatedly claim that Beshara's "substantial ego" and "inflated sense of self-importance" justified sending a strong message with the sentencing. Who knew that having a big ego was illegal? MacBride -- as he used to do with the BSA -- totally overplayed the claims of "losses" to the entertainment industry -- insisting that, every week, the MPAA alone was harmed to the tune of $1.5 million, "resulting in a staggering sum if the figure is extrapolated" to cover the 120 weeks that the site was in existence. Here's a tip, Neil, if extrapolating leads you to "a staggering sum," perhaps it's because your assumptions are wrong.

Either way, the judge appears to have decided not to completely buy into these claims of harm. While the government "agreed to limit the loss" to just $1 million, even though "the harm was certainly far more than $1 million," the judge seems to have capped the financial restitution to just her salary from NinjaVideo. The judge appears to have chosen not to also include a fine (which sentencing guidelines would allow between $10,000 and $100,000). On top of that, the judge gave Beshara less time in jail then either what Beshara claimed she expected (3 years) or what the sentencing guidelines and MacBride suggested (46 to 57 months). It seems that the judge didn't buy into all of MacBride's assertions.

Either way, expect the government to play this up as some huge victory against the scourge of online infringement and use it to justify continued censorship of websites.

ICE Mistakenly Deports Missing Teen To Colombia

Wow. We've discussed, repeatedly, the ridiculous situation in which the US government via the ICE (Immigration and Customs Enforcement) arm of the Department of Homeland Security has been seizing domains and censoring websites, such as the case of Dajaz1.com. As we've noted in the past, the details of that operation showed an organization that didn't really understand what it was doing, and definitely seemed to believe in "shoot first, ask questions later."

As many people have pointed out, why is "Immigration and Customs Enforcement" doing anything involving the internet or copyrights/trademarks online? So perhaps you could "excuse" their vast mistakes as them being out of their depth.

But what about the part of their mandate that they're actually supposed to be experts in? You know, keeping people who don't belong here out? Yeah, it appears they approach that with about the same level of detail awareness as when they deal with censoring blogs. In 2010, 14-year-old Jakadrien Turner ran away from home, "distraught over the loss of her grandfather and her parents' divorce." Her grandmother searched for her with no luck... until now. It seems that at some point in 2010 Jakadrien was arrested for shoplifting. She gave police a fake name... and that name apparently was the same as an illegal immigrant who was wanted in Colombia. And, that was enough to get the girl deported to Colombia last April. She remains there, currently detained by the Colombian government.

Apparently ICE took the girl's fingerprints "but somehow didn't confirm her identity and deported her to Colombia, where the Colombian government gave her a work card and released her." They've since taken her back into custody, since it was discovered she wasn't who they thought she was. ICE now says that they're "fully and immediately investigating this matter in order to expeditiously determine the facts of this case." Perhaps -- and this is just a suggestion -- ICE should start "fully and immediately investigating" stuff before they go around creating new and bigger problems...

Senator Wyden Demands Answers About Feds' Seizure Of Dajaz1

If the feds thought that they could seize the Dajaz1.com blog, hold it for a year in secret, then return it and pretend nothing really happened... it appears they may be in for a bit of a surprise. Senator Ron Wyden has begun his investigation into the matter, sending detailed requests for information from Attorney General Eric Holder, ICE director John Morton and White House IP Czar Victoria Espinel. You can see the three letters embedded below. There are a lot of questions to each of them, with a big focus on who they were talking to about the seizures (e.g., the RIAA) and what they were saying. They also ask questions about the legal basis for the seizures and even the training and procedures involved. I'll certainly be interested to see the replies when they come in...

ICE Admits That It Just Wants To 'Put People In Jail' With Operation In Our Sites

Rob Fischer has a fantastic article at The American Prospect, looking at ICE's Operation In Our Sites program, with a specific focus on the seizure and subsequent prosecution of NinjaVideo. It's worth reading in its entirety, as a few things become clear. Here are just a few interesting tidbits, though. First up, the site's admins noted that they had done their best to abide by the DMCA, and they figured that if anything, they might have to fight a civil lawsuit, not a criminal one:

Under the Digital Millennium Copyright Act of 1998 (DMCA), copyright owners are responsible for sending takedown notices to sites hosting infringing content. Anyone on YouTube who has ever read the statement “This video has been removed due to terms of use violation” has seen the result of a DMCA notice. “We believed that if we didn’t host the content but linked to it elsewhere on the Web, our only legal consideration was complying with takedown notices,” Beshara says. “And we always complied.”

But it wasn’t so simple. The DMCA takedown process allows intermediaries like YouTube to avoid liability because it’s their users uploading the infringing content. Ninja Video was both the intermediary and the uploader. Independent storehouses called “cyberlockers” hosted the content Ninja Video streamed, but Ninja’s uploaders put it there.

I'm not sure that this is really an accurate explanation of the DMCA issue, seeing as the users uploaded the content... that's the same thing with YouTube and Veoh, both of which have been declared legal under the DMCA. As long as they followed the safe harbor provisions, the fact that users upload shouldn't have an impact. There very likely may have been issues of secondary liability if the site encouraged people to infringe -- but that's a separate issue, and one that again should have been an issue for civil copyright law, rather than criminal.

The folks at ICE come across as typical meatheads with no clue what they're dealing with here. The real humdinger of a quote comes from ICE Special Agent William Ross, who earlier in the piece notes that he was influenced by Hollywood repeatedly asking him to do their job. But when confronted with the point (made by Corynne McSherry from EFF) that "Arresting people and putting them in jail for having some links online doesn’t really strike me as a good way for us to invest our time and energy." Ross hits back:

“I am a law-enforcement officer,” says Special Agent Ross. “I want to put people in jail.”

That, alone, is a pretty ridiculous and scary quote when you think about it. He's not talking about fairness or justice or upholding the law. He just wants to "put people in jail." People like that shouldn't have jobs in power.

In the end, it seems clear that the folks at Ninja Video received horrific legal advice and made some equally poorly thought out legal decisions themselves. I still don't see where the site's operators could have possibly been liable for criminal copyright infringement, but after throwing away the $10,000 they raised on lawyers, who (from the description in the article) did not appear to do very much (and it's not clear they ever understood fully what was happening), the admins quickly caved to government pressure on plea bargains.

In the wake of the Dajaz1 debacle by the Justice Department, it seems even more ridiculous that the NinjaVideo folks agreed to the plea deals. If they'd just received some decent legal advice early on, they wouldn't now be facing years in jail. Pretty unfortunate.

In the meantime, what you get is a ridiculous portrait of a bunch of "we just want to put people in jail" semi-clueless ICE agents (they repeatedly use Alexa as their judge of what's popular -- can no one buy them a subscription to a decent online monitoring service?) who don't even recognize the First Amendment implications of seizing sites with tons of non-infringing content on it, and who seem to be totally in awe of big entertainment companies and the myths they tell. The whole thing would be amusing if it didn't involve serious Constitutional questions and if people weren't ending up in jail.

Small Entertainment Web Site Fears SOPA Will Cause It To Shut Down... But ICE Can Already Shut It Down

Paul Tassi has an article up at Forbes, where he explains how the blog he runs for a living, Unreality, which covers movies/tv/video games, would be at risk of being shut down under SOPA. Even though his site has nothing to do with infringement, he's still quite reasonably worried:

My site likes to find the best media-related content on the internet. We post photos, artwork and embed YouTube videos that involve things about our favorite movies, shows and games. I always give credit where it’s due, but on occasion, a photographer or artist cannot be located. Under SOPA, should they find their content on my site, they would legally have the right to petition my advertisers to stop paying me, or report me to the government. The same goes for YouTube videos I might feature. Though the content is not mine, as I haven’t uploaded it to the web myself, I am indeed linking to it, and with this new law, I would be subject to the same sort of harsh penalties should the content within be something copyrighted like footage from a game or movie. I am willingly linking to “infringing” content, and under SOPA, can be branded a “rogue site” because of that. Such a classification could cause me to lose everything.

It's not clear if Tassi is in the US. If he is, then he's actually (partially) exaggerating, because as of Monday, SOPA no longer applies to US sites. But that's not good news. Because if he's a US site, then he's already subject to bogus seizures by the government, by which his web site could totally disappear for over a year with no due process whatsoever. Actually, no matter where he is physically, his site -- as a dot com -- is already subject to that kind of censorship. Even without SOPA. All someone has to do is convince a somewhat clueless Immigrations & Customs Enforcement official that his site has lots of infringing content on it -- even if it does not.

I don’t understand the entertainment companies’ end game here. They’ve gone beyond obtuse to straight up maniacal. Do they think if they manage to shut down every bit of copyright infringement on the internet, that sales are going to suddenly skyrocket? Do they think people have some secret horde of cash that they’ve just been waiting to blow on DVDs and CDs, but haven’t because of The Pirate Bay’s existence? If my site can’t link to gameplay videos or movie clips, are my readers going to run out and buy them to see what they’re missing? If they land Unreality on a rogue evil pirate site list, who benefits? I’m suddenly homeless, without any cash to go the movies.

It's a good question. The "end game" is all about control. The legacy entertainment industry built their business models entirely on the basis of the idea that they, not consumers, controlled the market. Everything they're doing is seeking to regain that lost control. As Tassi notes, none of that will actually make people buy more. But that's never what this was about.

Freedom Of Information Document Dump From ICE About Domain Seizures Almost Totally Redacted

With the (way too late) return of Dajaz1.com after over a year of prior restraint and denied due process, there's increasing interest in Homeland Security's efforts to censor websites through its Immigration and Customs Enforcement (ICE) division. Earlier this year, we noted that ICE appeared to be stalling in response to Michael Robertson's Freedom of Information Act (FOIA) request for info related to the round of domain seizures that got Dajaz1 (as well as still unaccounted for domains OnSmash.com and Torrent-Finder.com).

Robertson has sent over the entirety of what ICE eventually sent over. They claimed to have found 754 responsive pages... but 144 of those pages are completely redacted. The other pages are also full of redacted info. I've gone through a few hundred of the pages, and it's pretty useless. It basically looks like the administrative paperwork ICE filed on its activities. Details are pretty slim, though you can catch a glimpse of their thinking here or there -- such as saying that when seizing domains that are still part of an investigation, "no seizure noticed should be issued to the violator." Ah, the US government -- seizing speech and refusing to even notify those impacted.

Either way, I figure with a lot more eyes looking over these documents, perhaps someone would pick up a detail or two that isn't readily obvious on a quick skim of all the documents... so have at the embeds below:

Justice Department Hanging Onto Torrent-Finder Because It Doesn't Like How Search Engines Work

In the wake of the news about the federal government completely censoring dajaz1.com for over a year on no legal basis, we've been wondering about some of the other websites that ICE has seized that have asked for the domains back -- without any further due process. Torrent-finder.com, which unlike the blog Dajaz1.com, is just a search engine, let us know that their situation is just slightly different. But what it comes down to is that the Justice Department doesn't like search engines and is waiting for Torrent-Finder to come up with a way not to find infringing materials:

The status of torrent-finder is different than other domains: we’re working with ICE to regain the domain by proposing methods torrent-finder can modify its search engine to ameliorate problems identified in the seizure. Broadly speaking, these are problems that IPR has identified with search engines in general. We’re confident that this process will result in release of the domain name, and validation that torrent-finder.com’s business is not based on infringement. In the meantime, my client’s torrent-finder.com business has essentially been given the death penalty: over one year has passed with the domain offline, while the wheels of justice seem to grind more slowly than ever.

Is this really what we want or what the law allows? For the government to completely shut down a search engine for over a year with no actual court process, while the search engine gets to "propose" different ways to build a search engine... while waiting (and waiting and waiting) for DOJ officials to get back to them on how search engines should work in their "expert" opinions?

What Other Websites Is The US Government Secretly Censoring?

We're still trying to understand the overall fallout from last week's news that the feds seized and censored the music blog Dajaz1.com for over a year and blocked every chance for the site to get its day in court... before finally giving up and just handing back the site. And while lots of people have focused on that story, it seems worth asking what about the others? Back in June, we released a list of five domains whose owners had asked the government to return them. Two of them, rojadirecta.org and rojadirecta.com, have been involved in a lawsuit. The government sought to forfeit those two domains (i.e., get to keep them permanently) -- but did so only after rojadirecta's company, Puerto 80, filed a lawsuit officially demanding the return of the domains.

As far as we know, the other three sites all followed a slightly different process, which involved them officially petitioning the government to return the domains -- at which point the government has 90 days to either begin forfeiture procedures or to hand back the domain. That was in early June. As we know, with Dajaz1, the government had already begun getting a series of totally secret (indeed, we have no idea if they really exist) "extensions" from the court to allow them to hang onto the domain much longer without actually facing them in court over a forfeiture process. With Dajaz1, the government finally gave up and gave the domain back.

But there are still two domains unaccounted for: OnSmash.com and Torrent-Finder.com. Again, the list we posted back in June was an official list from DHS/ICE noting sites who had asked for the return of their domain. Even if we assume that such requests were made on June 13th (and they were all made significantly earlier), those domains either should have been returned or forfeiture proceedings started by mid-September at the latest. But we're in December, and as far as we can tell, no such procedures are under way.

That leaves two options: OnSmash and Torrent-Finder rescinded their demands for the return of their domains... or they're currently in the midst of the same Kafka-esque government-run secret censorship program. And, for all we know, there may be other sites as well.

So it seems like Attorney General Eric Holder and the Justice Department (as well as the folks at ICE) have some explaining to do. Who else are they censoring without due process? How many other sites had speech seized and are being denied their day in court? Just how deep does this program of the federal government censoring online websites go?

ICE Admits To Returning Domain While RIAA Threatens Dajaz1 With More Legal Actions

The continuing saga of the Dajaz1 censorship is unfolding in interesting ways. While some of us thought that both ICE and the RIAA owed Dajaz1 a pretty big apology for wrongly seizing and censoring the site for a year, all while denying due process, those two organizations apparently have other ideas. ICE gave an almost content free statement to Tim Lee:

ICE spokesman Ross Feinstein told Ars that "the government concluded that the appropriate and just result was to decline to pursue judicial forfeiture."

So what took so long? Feinstin wouldn't elaborate on why the domain was seized or why the government had changed its mind.

If the "appropriate and just result" was not to pursue forfeiture... then it seems quite reasonable to ask if the actual "appropriate and just" thing would have been to have never seized the domain in the first place. Or to have given it back when asked.

Meanwhile, we'd already noted a weird statmenent from the RIAA on the subject, but the organization issued a more detailed response to Jon Healey from the LA Times:

We understand that a decision was made that this particular site did not merit a criminal forfeiture proceeding. We respect that government agencies must consider a range of technical issues when exercising their independent prosecutorial discretion. Criminal proceedings are not always brought, for a variety of appropriate reasons.

With respect to Dajaz1, we would note that this particular website has specialized in the massive unauthorized distribution of pre-release music -– arguably the worst and most damaging form of digital theft. For a year and a half, we monitored the site, identifying instances where its operators had uploaded music to unauthorized file-sharing services where the recordings could be freely downloaded -- music that artists had created with the expectation that they would have a chance to sell before it was leaked. Dajaz1 profited from its reputation for providing links to pre-release copies, and during that time nearly 2,300 recordings linked to the site were removed from various file-sharing services. We are unaware of a single instance where the site operator objected by saying that the distribution was somehow authorized.

If the site continues to operate in an illegal manner, we will consider all our legal options to prevent further damage to the music community.

We are aware of statements by the site operator that suggest that music companies themselves were the source of at least some of the thousands of recordings available on Dajaz1. Even assuming this to be accurate, it does not excuse the thousands of other pre-release tracks also made available which were neither authorized for commercial distribution nor for uploading to publicly accessible sites where they were readily downloadable for free.

Note the lack of an apology for taking away their property on no legitimate basis for over a year. Even if we grant the RIAA their premise that the site infringed (which we don't), does it still make it right that the domain was completely censored for a year, and that the government tried very hard to avoid having to give it back? How can the RIAA not apologize for such a situation?

Even more to the point, though, is the fact that the RIAA still insists the site was illegal, even after all of this. It seems to be issuing a threat to figure out yet another way to get a bite at this apple, despite it being rejected. And now you know why the RIAA supports SOPA and PIPA. Under those laws, it would be that much easier to knock out competition and innovation.

Of course to understand some of the details of how these blogs work, and why the RIAA is being misleading, at best, there's a great and insightful comment from R.K. Udeshi on Hacker News, who explains:

If you're not familiar with hip-hop music blogs like the one cited in the article, please visit http://nahright.com or http://missinfo.tv to get a better idea of what they look like (since dajaz1.com doesn't seem to be back up yet, understandably).

Almost every track posted to sites like these are released by the artists themselves (or by their labels). Many hip-hop blogs (including the two I linked) will not post songs if they weren't legitimately authorized by the artists (e.g. if a track was stolen and leaked on the web).

Something you won't ever see are full albums. These sites aren't designed to replace album sales, they actually encourage them. They will only link to individual songs or freely released mixtapes.

(Also, you'll note that a lot of the music posted is from unsigned artists. A lot of newer rappers actually rose to prominence after having their music posted on these sites.)

There are many, many sites that willingly infringe on copyright and the government has good reason for shutting down. This was not one of them.

That makes the point quite succinctly. These blogs are the new radio, and there's a total disconnect between the lawyers and the marketing folks. Of course, it's one thing for there to be confusion between two parts of a company... and quite another for that disconnect to lead to outright censorship and denial of due process.
