I would be fine with their policy on FreeConference calls, or any other type of expensive usage, if they just stated that. Something along the lines of, 'At this time, we cannot facilitate the use of FreeConference.com or other such services because of their expense. However, we do offer an alternate service....". That's the point isn't it? MagicJack made promises that it couldn't deliver on (for perfectly valid reasons) and it refuses to make good on their promises or even stop making those promises. That's pretty shitty, regardless of the cost.

The laws that allow this scam to operate are stupid and he has spoken out again them already. If they don't want to fix the problem, why should it concern us that they are being scammed out of money?

First, this is not a news site or a 'news' site. Mike is not a journalist and doesn't claim to be. Deal with it or move on.
Second, they do 'offer' a return policy, but they have a practice of dating checks and then waiting several days to send them out so they arrive too late to get a refund. The BBB dropped them because of it. I have also heard complaints about being the line not being answered, being transferred to nowhere, and flat-out hung up on when called for a refund.
Third, Cash Advance/PayDay Loan companies operate under very strict guidelines. Cash4Gold *should* operate under similar standards but, apparently does not, as they are being investigated for not following the law when purchasing precious materials.
Alot of song liners don't even come with lyrics. I'd say that more didn't than did, although it's been at least 5 years since I've purchased a CD new and the used discs don't usually come with the liner notes. :)
Got all of the D&D 3.5 books (even the controversial Book of Erotic Fantasy, hey, it was free) in .pdf format from a friend. Got the basic book from Waldens but didn't feel like paying a ton for the additional books that I was rarely going to use. I wouldn't have paid more than ten dollars for the bunch of them altogether in .pdf format. Would pay ten or fifteen bucks a pop for softcover guides, tho.
This is very similiar to the law firm who got sued because they purchased a site that had some infringing material. How were they supposed to know? They purchased the material in good faith.
I know that in my jewelry store, we purchase jewelry from people, and it if turns up stolen, the police and the victims certainly don't hold us responsible! The person who stole the items is responsible. If that is true for real goods, how could it be less true for intellectual property?
Oh, man, I will listen to Amanda Palmer babble all day long. Also, Neil Gaiman's babble. And them back and forth is even better than one individually. Oh plus, interesting amusing people that I will never meet in real life, whose gender I sometimes don't even know. And in the end, all of this babble will still be classier and less pointless than a single episode of 'The Hills' or 'Gossip Girl'. So, anyway, the point of the babble is 'entertainment'.
And since when is human interaction pointless, regardless of it's entertainment value?
I have never worked for a company that had a good idea of what it wanted. I design sites for small-medium local businesses and most of these people have no clue what they want. Or how to do much beyond check their e-mail, in fact. :)
In the few cases where I get people who have color schemes and text all picked out, I sometimes have to talk them out of it into something better, or risk ending up on www.webpagesthatsuck.com.
I specialize in complete site solutions, so we usually do come up with the marketing text and everything else, something including logo design and the whole works for new businesses. We probably could just wholesale nab text and code from other people, but we have more integrity than that. (Also, that's just boring.)

The design firm obviously knew (because it was verbatim) and they should be liable.

There will, however, always be a market for the really hard-core stuff or for the the porn connoisseur. More competition just means that everyone has to work harder and better to get paid. What's wrong with that?
Start with your friends list. Divide them into categories (I have Work, Friends, & Family). People can be in multiple lists. Then, when you go to post, click on the lock icon and a list of options will pull down like 'Show Only To' or 'Do Not Show To'. You can choose to block groups or even individuals. :)
You can already do that. Alot of my older family members are on Facebook and I usually block them from seeing any posts that are not G-rated. Same with albums, etc. They don't even know they can't see it, lol.
