I found it interesting that one of the first things Judge Hunt did was site precedent for the defendant being the prevailing party when the suit is dismissed for lack of standing. If memory serves me correct, this is one of things that Righthaven had tried to use for the basis of appeal in a previous case.
TSA does screen, and is responsible for checked bags as well as carry on. The screenings for checked bags emphasize explosives rather than hand weapons.
The gun falling out does not meet the shipping requirements for transporting a weapon, but it is perfectly legal to have an unloaded weapon in the baggage compartment.
The TSA messes up so much. I think we should focus on the things that matter. If we scream about the petty things it makes the screams about the true injustices more easily ignored.
This is actually a pretty easy concept to understand. The music previously belong to us, the public. They took it away. They did not pay us for it. What right does congress have to take something from us to give to an individual so that they can make money, and we have to start paying for something that was ours???
Unless they patented the process of taking a router out of the box and hooking it up, it seems that they should be suing the manufacturers, and not the establishments using the equipment.
He said in his e-mail "It has become clear that the only limiting factor on how much value I am to a case is how much responsibility I am given: the more responsibility I am given, the better the outcome."
The firm gave him 100% responsibility, for finding his cases, for trying his cases, etc.
While I feel copyright law in general is absurd, I think the way Maxwell set up the business, made it very easy to offer the argument that the only difference between their operation and a multiplex theater was the number and size of the viewing rooms.
It seems to me that had Maxwell's separated the transactions, it would have been harder to make the public performance claim.
Transaction 1 - Movie rented with right to leave store with it and keep it for the normal rental period.
Transaction 2 - Rent room with TV and VCR (in room), not behind counter. Customer rent's room for specific period of time, and can watch rented tape or tape they acquired elsewhere, or sit and twiddle thumbs for that mater during the time frame.
If customer elects to rent tape, rent room, watch tape, and then return tape without leaving, so be it.
What's wrong with you people. This woman is obviously a great songwriter and has written most of the recent big hits of the day. Oprah should quickly settle, because she has probably met some of the people who recorded these songs.
DirecTV is offering these overpriced rentals. I have received at least two e-mails advertising different releases. I would point out that the price on these ads is not high-lighted.
I wonder if there is anyway to get any information on how many people actually spend the money. I also wonder how many people have to buy before it is worth the satellite bandwidth to offer them.
I think the people who are suggesting they be paid for their comments are totally wrong. I will however be organizing a class action suit for those writers who have. Contributed a "xxxxx's Favorite posts of the week" column. I won't be a member of the class, but I'm sure I can monitize it somehow.
We should actually be more outraged by 'Eldred', at least in 'Kelo' the owners of the property were compensated. With pulling of items out of the public domain, the public received nothing to offset the benefit given to the copyright holders.
Am I missing something, or is the complaint saying that the lead plaintiff is a former employee of Coach, but later in the complaint when they define the class they specifically exclude any employee or former employee of the defendant.
