Everyone Panic: Teens Are Sending Each Other Naked Photos On Camera Phones

When I first read this article from the Associated Press about this new teen fad of teenagers using camera phones to send each other naked photos of themselves, I'll admit that I reacted exactly as the article's authors probably intended -- wondering what the hell kids are up to these days. However, is this really that surprising or shocking? At that age, kids do all sorts of stupid things, and if you hand them tools like camera phones that make it so easy, it's no surprise that some kids, somewhere will do things like pass around naked photos of each other (which, by the way, opens them up to charges of child pornography). Hell, kids have been "playing doctor" for ages, and it didn't necessarily warrant a writeup in the Associated Press.

And, while the article does list out multiple such cases, there's no indication how widespread this really is. Yes, there are some kids out there who do stupid, impulsive things (especially when it involves members of the opposite sex that they're interested in), and hopefully people realize these are just isolated incidents. But, somehow, I get the feeling we'll soon be hearing people suggesting that this is a "common occurrence" rather than just a few isolated incidents. So, really, the story here is that there are some kids out there that don't have the best judgment, and sometimes a small number of those kids do stupid things. It just so happens that, these days, those stupid things can involve being naked on the internet.

Patent Battles Continue Over Wireless Email

While RIM is often portrayed as a victim for having to pay out $612.5 million in the patent infringement lawsuit filed by patent holding firm NTP, what gets less attention is that part of what kicked off NTP's lawsuit was the fact that RIM itself was going around suing pretty much everyone for patent infringement itself. And, of course, that kicked off all sorts of copycats, such as Visto -- a company that clearly learned the art of wielding patents against more successful companies from NTP. Visto and RIM ended up in quite the patent battle, with Visto even claiming that RIM should be shut down.

But, in the end, rather than the other way around, it turned out that it was Visto that was found to be infringing on RIM's patents. At this point, though, hasn't anyone realized how ridiculous it is that there are so many companies claiming to hold patents on some aspect of "wireless email" that no one can enter the space without having a bunch of infringement lawsuits waiting for them? This is not what the patent system was designed for.

Sorry T-Mobile, Other Companies Can Use The Color Magenta

A while back T-Mobile received a trademark on the color magenta for use in selling mobile phone services in certain markets, but it seems to be taking the trademark a little more seriously than it should, even to the point of threatening the blog Engadget for having a magenta-colored logo. It also took mobile operator Telia to court in Denmark for its own use of a magenta logo, but missed out on a couple of important facts: Telia and T-Mobile don't compete in the same markets in Denmark and (more importantly) Telia's magenta is a different shade of Magenta. The court has not just tossed out the lawsuit, but has dumped the court costs and Telia's legal fees onto T-Mobile's bill. Hopefully that will teach them that trademark law shouldn't be abused.

Yet Another Company Thinks It Can Stretch WiFi To Compete With WiMAX

For years and years and years we've been hearing about companies that claim to have taken WiFi and been able to turn it into a wide-area technology. Yet, every time, the reality is a lot less appealing. The technology rarely works, except under specific ideal conditions. So forgive us for being skeptical of yet another company claiming that its special take on WiFi can take on WiMAX. It's even come up with the name MaxFi that's almost certain to have the WiMAX folks checking with their trademark lawyers. While it's nice to see some folks trying to do more with the technology, given the long trail littered with failed plans for wide-area WiFi, let's consider this one to be yet another story that makes a nice headline and little else.

RIM Tells India That It Simply Cannot Snoop On Blackberry Email

A few months back, we noted that the Indian government was demanding that RIM let government officials snoop on emails sent via Blackberry devices, or they would be banned in India. I'm not sure why it took so long for RIM to point this out, but it finally has explained to the government the nature of its encryption scheme which means that RIM itself cannot decrypt messages sent via the network, since they're based on an encryption key set up by the end user. It's not clear how India is going to respond, though the article notes the two sides are "talking."

If You're Going To Claim That WiFi Violates The ADA, Shouldn't You Need To Prove It Actually Hurts People?

Hot on the heels of yet another silly bogus WiFi health scare, Broadband Reports points us to a story of some folks in Santa Fe, New Mexico who aren't just worried about the health effects of WiFi, but are insisting that putting WiFi in public places is a violation of the Americans with Disabilities Act. Having once taken an entire college class on the ADA (admittedly many years ago), I'm having trouble recalling which section would apply. Given that double-blind studies and various tests have shown no evidence of WiFi having an impact on people, you would think that those worried about it would have the burden of proof in demonstrating a real health problem. And, given those double-blind studies, it should need to go beyond random people insisting that WiFi makes them feel ill.

Advertising Isn't A Mobile Strategy

ReadWriteWeb has an article claiming that the way to beat Google is by having a better ad platform (via Matt Asay). It says that "the company that can corner the mobile web ad market is going to be able to go toe-to-toe with Google." This is getting things completely backwards. Google doesn't dominate the search engine market because it has the best advertising platform. It dominates the advertising market because it has the best search platform. Other companies, such as AOL, that have seen themselves as an advertising company first and a content/applications company second have gone nowhere. This is especially true because the best advertising platforms are tightly integrated with their associated applications. One of the reasons Google's search advertising is so lucrative is that Google figured out how to make its ads highly relevant to users' search terms. This had two benefits. It increased click-through rates, obviously, but more importantly, it made the ads more useful -- and therefore less annoying -- to users. The same principle applies to the mobile space. Mobile advertising will only work if companies figure out how to make the overall user experience positive so that the ads don't scare users away. The way to do that is not to focus on building the best possible mobile ad platform, but rather to build the best possible mobile services, and worry about monetizing them after they've built up a significant user base.

EVDO Isn't A Third Pipe: Sprint Follows Verizon Wireless With 5GB Caps

Well, this is unfortunate. Every time people want to pretend that there's "real" competition in the broadband market beyond DSL and cable, you hear them talk about 3G wireless services like Sprint and Verizon Wireless' EVDO. Of course, Verizon Wireless caps its EVDO service at 5GB/month -- go over that and it will cut you off. Sprint, however, remained customer friendly and having sold people "unlimited" plans, stuck to that plan and let folks use EVDO as much as they wanted to. I'm one of those customers, and have been a big fan of the service. When I travel, I use it constantly. It's convenient, reliable and more secure than WiFi. While it's not often, on heavy travel months, I almost certainly pass that 5GB barrier. Yet, now, according to Gizmodo and Phonescoop, Sprint is implementing its own 5GB cap. You can make all sorts of arguments about why it needs to do this -- or point to the fact that (eventually) it will have a WiMax network available (though, not for a while). But, in the meantime, a bunch of us were told that we were buying "unlimited" service. 5GB is hardly unlimited, and it's rather ridiculous to go back and change the deal after the company had already sold it to us. Either way, any time someone suggests that EVDO is a "third pipe" competitor to DSL or cable, remind them that it's an extremely limited third pipe with rules that change with almost no notice.

Betting On Mobile Phones Won't Save The Recording Industry

The recording industry hasn't had much of a strategy for dealing with the changing marketplace over the past decade (and, no, I don't consider lashing out and suing music fans as a "strategy"), so far be it for them to start now. That's why it's amusing to see articles about how the recording industry honchos are now betting on a new generation of mobile phones to save them. Funny how that works. This is the same group of executives who will claim that the phones themselves have no value without the music -- and yet here they are hoping and praying that the devices will save their industry.

But the real problem is that this isn't a strategy. It's wishful thinking. It doesn't involve any actual insight into what's happening in the market. It doesn't involve any proactive movement towards accepting new business models and changing the way business is done. It's merely the old way of thinking, trying to figure out what the "next" platform will be on which to sell music. It went from vinyl to cassette tape (we'll skip 8-track) to CD to computer... and now they want it to go to mobile. But they're missing the fact that the more popular mobile devices get, the sooner it is that we'll see file sharing apps for mobile devices pop up. Rather than waiting and praying that some new platform will be the savior, isn't it time that the industry started taking lessons from the past 10 years, and worked towards adapting to the age of digital content?

Musicians Whining About Fans With Mobile Phones

This past Friday night my favorite band was in town, so I went out to see them perform at a club in San Francisco. It was a fun time and they put on a great show (as they usually do) -- and it struck me early on that, even though the club was mobbed, and every once in a while I saw someone pull out a mobile phone to snap a photo or take a video, most people were just dancing and enjoying the show. Apparently, that's not necessarily the case everywhere. PicturePhoning alerts us to an article where a bunch of musicians are whining about fans in the audience with mobile phones. While they do make some interesting points about how fans these days are so focused on documenting their experiences that they might miss the actual experience, the whole "controversy" seems overblown. If the experience is good, the experience is good, and why should the musicians care how the fans experience it? And, as I can tell you from my experience on Friday night, when the experience is top notch, most people don't bother to pull out their mobile phones. So, perhaps rather than worrying about what the fans are doing, musicians should concentrate on putting on a better show.
